THIS CONTEST IS
INTENDED FOR PARTICIPATION BY INDIVIDUALS IN HIGH SCHOOL (GRADE 9 – 12) AND POSTSECONDARY
EDUCATION STUDENTS (UP TO 26 YEARS OF AGE) WHO ARE RESIDING IN THE 50 UNITED STATES OR WASHINGTON DC AND WHO
OTHERWISE MEET THE ELIGIBILITY CRITERIA IN SECTION 2. THE CONTEST WILL
BE GOVERNED BY DELAWARE LAW. ELIGIBLE ENTRANTS WHO ARE UNDER 18 YEARS OF AGE OR
UNDER THE LEGAL AGE OF MAJORITY OF THEIR STATE OF PRIMARY RESIDENCE ("MINOR") AT THE TIME OF ENTRY MUST
OBTAIN THEIR PARENT'S OR LEGAL GUARDIAN'S PERMISSION TO PARTICIPATE. FURTHER ELIGIBILITY RESTRICTIONS ARE CONTAINED
IN THE OFFICIAL RULES ("OFFICIAL
RULES") BELOW.
1. DESCRIPTION: The "Leading Con Educacion
Contest" (the "Contest")
offers eligible entrants (each an "Entrant"
and collectively the "Entrants")
the opportunity to create and submit two (2) essays (each an "Essay" and collectively the "Essays") inspired by their
learnings from the free TurboTax Tax Simulation course
(the "Course") for consideration as described below.
The Sponsor of this Contest is EVERFI, Inc. ("Sponsor"), 2300 N Street NW, 4th Floor, Washington,
DC 20037. The Presenter of this Contest is Intuit Inc. ("Presenter"). The Administrator of
this Contest is Creative Zing Promotion Group, LLC ("Administrator"), 2100 E Robinson Street, Orlando, FL 32803.
Sponsor, Presenter, and Administrator shall collectively be referred to as the "Contest Entities". Void where prohibited or restricted
by law. By participating in the Contest, each Entrant unconditionally accepts
and agrees to comply with and abide by these Official Rules and the decisions
of the Contest Entities.
The Contest
will operate as follows:

CONTEST STRUCTURE: The
Contest consists of two (2) separate entry pools (each an "Entry Pool"),
determined by the eligible Entrant's status as either a high school student or a
postsecondary education student. Twenty (20) prizes are available per Entry Pool
(40 total prizes for the Contest).
●
SUBMISSION PERIOD: The
Submission Period begins on about Friday, February 17, 2023, and ends at
11:59:59 pm Eastern Time ("ET") on Sunday, April 30, 2023 (the
"Submission Period").
●
SUBMISSION
REVIEW, EVALUATION & JUDGING: Concurrent with and
following the Submission Period, eligible Submissions (as defined in Section
3) will be reviewed and evaluated according to the criteria in Section 4
of these Official Rules by judges selected by the Contest Entities (each a "Judge" and collectively the "Judges").

WINNER NOTIFICATION: On or
about Tuesday, May 16, 2023, up to twenty (20) Entrants from the high school
Entry Pool and up to twenty (20) Entrants from the postsecondary Entry Pool (each
a potential "Winner," as determined by the judging results),
will be contacted to confirm eligibility, and obtain releases, according to Section
5 of these Official Rules.
2. ENTRANT ELIGIBILITY: For an
Entrant to participate in the Contest and to be considered as a potential
Winner, the Entrant must meet the following eligibility criteria:

Entrant must be a legal US resident physically residing in the
fifty (50) United States or the District of Columbia (or who qualifies under
DACA) who self-identifies as Hispanic.
o
High
School Entry Pool: At the time of entry, the Entrant
must be at least thirteen (13) years of age and a current high school student
(grades 9-12) enrolled at a public, private, parochial, or other institution, and
may be required to provide proof of such enrollment satisfactory to the Sponsor
if selected as a potential Winner.
o
Postsecondary Education Entry
Pool: At the time of entry, the Entrant must be a current postsecondary
education student up to twenty-six (26) years of age and enrolled at a college,
university, trade school, or other postsecondary educational institution and
may be required to provide proof of such enrollment satisfactory to the
Sponsor, if selected as a potential Winner.

Eligible Entrants under eighteen (18) years of age must have obtained their parent's or legal guardian's permission to
participate. If applicable, any
Minor Entrant may be required to provide parental or legal guardian's consent
in a form satisfactory to the Sponsor before they can be declared a potential
Winner.
●
This
Contest is not open to any officer or employee of a government or any
department, agency, or instrumentality thereof, or of a public international
organization, or any person acting in an official capacity for or on behalf of
any such government or department, agency, or instrumentality, or for or on
behalf of any such public international organization, or institution in any
jurisdiction and any Essay by any such officer, employee, or institution will
be rejected.
●
Entrant must be the rightful owner (or have authorized use) of the
email address identified on the entry form. In the event of a dispute over the
identity of an Entrant in the Contest, the Entrant will be deemed the
authorized account holder of the email address associated with the Submission
and he/she must comply with these Official Rules. "Authorized Account Holder" is defined as the natural person in
whose name the email account was opened. In the event a dispute regarding the
identity of an Entrant cannot be resolved to Sponsor's satisfaction, the
affected entry may be deemed ineligible, and an alternate potential Winner will
be selected.
●
Entrant must not be an employee, owner, shareholder, officer, or
director of Contest Entities, Presenter, or any of the foregoing's parent
companies, affiliates, divisions, subsidiaries, agents, representatives,
promotion, and advertising agencies, together with the immediate family members
and/or those living in the same household of any of the foregoing persons
(collectively, "Household Members").
For purposes of the Contest "Household
Members" shall mean those people who share the same residence at least
three months a year; "Immediate
Family Members" shall mean parents, stepparents, legal guardians,
children, stepchildren, siblings, stepsiblings, or spouses. Void where
restricted or prohibited by law.
3. HOW TO ENTER &
SUBMISSION REQUIREMENTS: During the Submission
Period, eligible Entrants must visit turbotax.everfi.com/tax-simulation/ to complete the Course. Upon completion of the Course, the
Entrant must follow the on-screen instructions to complete the entry form with
their full name, email address, and school. Next, the Entrant must follow the
on-screen instructions to submit two (2) Essays and correctly answer one (1)
Course-related question, as further described below.
Essay One: Essay must
be at least one hundred (100) words and no more than two hundred fifty (250) words, and respond to the question/prompt below.

activities, or projects that relate to personal finance.
Essay Two: Essay must
be at least two hundred (200) words and no more than five hundred (500) words,
and respond to the question/prompt below.

about taxes in school, and how has the TurboTax Simulation given you more
confidence related to future tax filings?
o Describe your biggest takeaway(s) from the TurboTax
Simulation and how you plan to apply this knowledge in the future.
Course-Related Question: Entrant
must correctly answer the question below.
●
What is the name of one of the fictional characters in the
Course?
To be eligible for
consideration, the Course-Related Question must be answered correctly, and the
Essays must meet the following Essay Requirements:
●
Essays must be Entrant's own original, previously unpublished work;
●
Essays must be inspired by learnings from the Course;
●
Essays must be written in Spanish or English;
●
Essays must be relevant to the questions/prompts above;
●
Essays must comply with the minimum/maximum word requirements above;
●
Essays must not have won any other prize or award, must not have
been previously published, and must not have been submitted in any other
contest or promotion;
●
Essays must not include subject matter which is, or could be
considered, in the sole discretion of Contest Entities, obscene, pornographic,
violent, defamatory, libelous, discriminatory, illegal, offensive, threatening,
profane, hateful, degrading, harassing, or otherwise unlawful or is otherwise
considered objectionable by the Contest Entities;
●
Essays must not include material that infringes or violates any
applicable laws or regulations or any right of a third party, including (1)
patent, trade secret, or other proprietary or contractual rights; (2) right of
privacy or publicity; or (3) any confidentiality obligation; and
●
Essays must not include any derogatory references to the Contest
Entities or any of their parent companies, or any of their products or
services.
Note: Contest
Entities reserve the right, in their sole discretion, to disqualify any Essays
that violate the Essay Requirements, or potentially infringe or otherwise
violate a third party's rights or if the Essay is deemed to be lacking in
taste, quality, or is otherwise objectionable.
The
completed entry form, the Essays, and the answer to the Course-related question
shall collectively be referred to as the "Submission". ALL
SUBMISSIONS MUST BE RECEIVED BY SUNDAY, APRIL 30, 2023, AT 11:59:59 PM ET. LIMIT ONE (1) SUBMISSION PER ENTRANT. Any
attempt to obtain more than one Submission may result in disqualification from
the Contest. Incomplete, unreadable, or unintelligible Submissions will be
disqualified. ELIGIBLE ENTRANTS MUST ENTER IN ACCORDANCE WITH THESE OFFICIAL
RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. Participation in the
Contest constitutes the Entrant's understanding of full and unconditional
agreement to and acceptance of these Official Rules. Sponsor reserves the right
to disqualify any Entrant that Sponsor determines to be in violation of any
term contained in these Official Rules. Sponsor's decision not to enforce a
specific provision of these Official Rules does not constitute a waiver of that
provision or of the Official Rules generally.
4. SUBMISSION REVIEW &
JUDGING: Concurrent with and immediately following the Submission Period,
eligible Submissions for each Entry Pool will be reviewed and evaluated by the
Contest Entities' representatives ("Judges")
based on the criteria and weighting below ("Judging Criteria"). Up to twenty (20) eligible Submissions for
each Entry Pool with the highest point scores will be determined as potential
Winners, subject to verification of eligibility, execution of the Prize Claim
Documents, and in compliance with the Official Rules.

Uniqueness/Creativity: 25%

Clear
Expression of Idea/Proper Grammar: 25%
In the event of a tie within an Entry
Pool, the Essays associated with the tied Submissions will be reevaluated in
accordance with the criteria above to determine the potential Winners. Contest
Entities reserves the right to select fewer than twenty (20) potential Winners per
Entry Pool and/or to extend the Submission Period and all other dates
associated with the Contest in the event an insufficient number of eligible
Submissions are received, as determined by the Contest Entities, in their sole
discretion. All decisions of the Judging Panel are final on all aspects of the
Contest. Judging scores will not be revealed or publicly announced.
5. WINNER NOTIFICATION: Up to forty (40)
potential Winners, as determined by the judging results, will be notified on or
about Tuesday, May 16, 2023, using the email
address provided at the time of entry. Each potential Winner (or their parent
or legal guardian if a Minor) will be required to verify their permanent legal
address, their high school or postsecondary enrollment status and complete an
affidavit of eligibility, a liability release, and, unless prohibited by law, a
publicity release and other documents as may be required by Contest Entities in
its sole discretion (collectively, the "Prize Claim Documents") covering eligibility, liability, advertising,
publicity and media appearance issues. Failure by a potential Winner (or their
parent or legal guardian if a Minor) to return the Prize Claim Documents within
the specified time may result in forfeiture of the prize and selection of an
alternate Winner for the corresponding Entry Pool based on the judging results.
A prize will not be awarded/fulfilled until all such properly executed
documents are returned. Contest Entities, in their sole discretion, will
attempt to contact up to three (3) potential Winners of each prize in
accordance with the above procedure, after which the prize in question may go
unawarded if it remains unclaimed. Contest Entities reserves the right to
disqualify anyone not fully complying with the Official Rules. Winner must provide the Contest Entities
with his or her social security number for tax reporting purposes before the
prize will be awarded. Each Winner will receive an IRS Form 1099 for the full
value of the prize received for the year in which the prize is fulfilled.
6. PRIZES: Twenty (20) prizes are
available per Entry Pool (40 total), as described below.
Prizes (20 Per Entry
Pool Available/40 Total): One (1) Gift of College 529 gift card
in the amount of two thousand five hundred dollars ($2500.00).
ALL FEDERAL, STATE, AND LOCAL TAXES, AND ANY OTHER COSTS AND
EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE
RESPONSIBILITY OF THE WINNER. Winners cannot assign, transfer, or sell the
prize claim to another person. No prize substitution is allowed except at the
discretion of Contest Entities. Limit one (1) prize per person / per Household.
Contest
Entities will coordinate fulfillment directly with the Winner (or the parent or
legal guardian if a Minor). If the Winner doesn't already have an established 529
plan, more information is available at https://www.collegesavings.org/. Gift of College
529 Gift Cards are subject to separate terms, available at www.giftofcollege.com/purchasegiftcard/. Other restrictions
may apply.
7. CONDITIONS OF PARTICIPATION/RELEASES: Contest is void where
prohibited or restricted by law. All federal, state, and local laws and
regulations apply. By participating, each Entrant (and, in the case of a Minor,
such Minor's parent/legal guardian on his/her behalf) agrees to be bound by
these Official Rules and the decisions of the Contest Entities, which shall be
final in all respects. By participating in this Contest and/or by accepting any
prize that he or she may win, each Entrant (and, in the case of a Minor, such
Minor's parent/legal guardian on his/her behalf) agrees to release the Contest
Entities, Presenter and their respective affiliates, divisions, subsidiaries,
successors, assigns, and licensees, and each of their respective employees,
shareholders, officers, directors, contractors, advertising and promotion
agencies, agents and representatives (collectively, the "Released Parties") from any and
all actions, claims, injury, loss or damage arising in any manner, directly or
indirectly, from participation in this Contest and/or acceptance or use of any
prize. Each Entrant (and, in the case of a Minor, such Minor's parent/legal
guardian on their behalf) authorizes the Contest Entities to use their
Submission, Essays, name, voice, likeness, biographical data, city and state of
residence and entry materials in programming or promotional material, worldwide
in perpetuity, or on a winner's list, if applicable, without further
compensation unless prohibited by law. Contest Entities are not obligated to
use any of the above-mentioned information or materials but may do so and may
edit such information or materials, at Contest Entities' sole discretion,
without further obligation or compensation. The Released Parties shall not be
liable for: (i) late, lost, delayed, damaged, stolen, misdirected, postage-due,
incomplete, unreadable, inaccurate, garbled or unintelligible entries, release
forms, communications or affidavits, regardless of the method of transmission;
(ii) telephone system, telephone or computer hardware, software or other
technical or computer malfunctions, lost connections, disconnections, delays or
transmission errors; (iii) data corruption, theft, destruction, unauthorized
access to or alteration of entry or other materials; (iv) any and all losses,
damages, rights, claims and actions of any kind in connection with or resulting
from participation in the Contest; (v) acceptance, possession, grant, use of or
participation in any prize or related prize event, including without
limitation, personal injury, death and property damage arising there from; (vi)
claims based on publicity rights, defamation or invasion of privacy; or (vii)
any printing, typographical, human administrative or technological errors in
any materials associated with the Contest. Contest Entities disclaim any
liability for damage to any computer system resulting from participating in or
accessing or downloading information in connection with this Contest. Sponsor
reserves the right, in its sole discretion, to cancel, modify or suspend the
Contest (or any portion thereof) should a virus, bug, computer problem,
unauthorized intervention or other cause or problem corrupt or inhibit the
administration, security or proper play of the Contest and, in such situation,
to select the winner(s) from judging results or from all eligible non-suspect
entries received prior to and/or after such action or in such manner as deemed
fair and appropriate by the Sponsor. Sponsor may prohibit Entrant from
participating in the Contest or winning a prize if, in its sole discretion, it
determines you are attempting to undermine the legitimate operation of the
Contest by cheating, hacking, deception, or any other unfair playing practices
or intending to annoy, abuse, threaten or harass any other participants or
Sponsor's representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE
WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN
VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM
PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES
THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST
EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
8. INDEMNITY: Winner (and, in the
case of a Minor, such Minor's parent/legal guardian on their behalf) shall
indemnify, defend and hold harmless the Released Parties from and against any
and all claims, damages, actions, liability, loss, injury or expense, including
reasonable attorneys' fees and costs, arising out of or in connection with: (a)
participation in the Contest; (b) a breach or allegation which if true would
constitute a breach, of any of Winner's representations, warranties or
obligations herein; and (c) acceptance, possession, grant, participation in, or
use of any prize, including without limitation, personal injury, death and
property damage arising therefrom.
9. SUBMISSION REPRESENTATIONS AND
WARRANTIES: Each
Entrant (and, in the case of a Minor, such Minor's parent/legal guardian on their
behalf) represents and warrants as follows: (i) the Submission is the Entrant's
own original, previously unpublished, and previously unproduced work; and (ii)
the Submission does not and will not violate any applicable laws, and is not
and will not be defamatory, slanderous, or libelous.
Each Entrant (and, in the case of a Minor, such Minor's parent/legal guardian
on their behalf) hereby agrees to indemnify and hold the Released Parties
harmless from and against any and all third-party claims, actions, or
proceedings of any kind and from any and all damages, liabilities, costs, and
expenses relating to or arising out of any breach or alleged breach of any of
the warranties, representations or agreements of Entrant hereunder.
10. GRANT OF RIGHTS: Each Entrant (and, in
the case of a Minor, such Minor's parent/legal guardian on their behalf) into
the Contest hereby irrevocably grants to Contest Entities, their designees,
affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid,
universal license to use, copy, sublicense, transmit, distribute, publicly
perform, publish, delete or display the Submission in any media now known or
hereafter devised including, but not limited to all forms of electronic media,
print media and all forms of internet and wireless protocol in perpetuity and
throughout the universe for advertising, marketing, publicity and promotional
purposes in connection with the Contest and other promotions. Sponsor shall
have the right, in its sole discretion, to edit, composite, morph, scan,
duplicate, or alter the Submission for any purpose which Sponsor deems
necessary or desirable, and each Entrant irrevocably waives any and all
so-called moral rights they may have therein.
11. NATURE OF RELATIONSHIP/WAIVER
OF EQUITABLE RELIEF: Each Entrant and Winner (and, in the case of a Minor, such Minor's
parent/legal guardian on their behalf) understand and
acknowledge that the Contest Entities have wide access to ideas, designs, and
other materials, and that new ideas are being developed by their own employees,
suppliers, and/or business partners. Each Entrant and Winner (and,
in the case of a Minor, such Minor's parent/legal guardian on his/her behalf) also acknowledges that many ideas may be competitive with,
similar or identical to an idea and/or each other in theme, idea, format, or
other respects and agrees that he or she will not bring any claim or action
against any of the Contest Entities or any third parties and will not be
entitled to any compensation, as a result of any Contest Entities or any
third-party use of any such similar or identical material. Each Entrant, and
Winner acknowledges and agrees that the Contest Entities do not now and shall
not have in the future any duty or liability, direct or indirect, vicarious,
contributory, or otherwise, with respect to the infringement or protection of
copyright, patent, trade secret, proprietary or other intellectual property
rights in and to an idea and/or Submission. Nothing stated herein should
be construed to create any kind of employment relationship, contractor
relationship, partnership, or joint venture with any of the Contest
Entities.
12. GOVERNING
LAW: ALL ISSUES AND QUESTIONS CONCERNING THE
CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL
RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR THE CONTEST ENTITIES IN
CONNECTION WITH THE CONTEST OR IN CONNECTION WITH ANY SUBMISSION OR OTHER
MATERIAL SUBMITTED IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY AND
CONSTRUED IN ACCORDANCE WITH THE INTERNAL
13. DISPUTES: As a condition of
participating in this Contest, Entrants agree that any and all disputes which
cannot be resolved between the parties and causes of action arising out of or
in connection with this Contest, shall be resolved individually, without resort
to any form of class action or consolidated action, in accordance with the
arbitration provision below. Further, in any such dispute, under no
circumstances will Entrants (and, in the case of a Minor, such Minor's
parent/legal guardian on his/her behalf) be permitted to obtain awards for, and
hereby waive all rights to claim punitive, incidental, or consequential
damages, including without limitation attorneys' fees, other than Entrant's
actual out-of-pocket expenses (e.g., costs associated with entering) if any,
and Entrant further waives all rights to have damages multiplied or increased.
14. ARBITRATION PROVISION: By
participating in this Contest, each Entrant (and, in the case of a Minor, such
Minor's parent/legal guardian on their behalf) agrees that any and all disputes
the Entrant may have with, or claims Entrant may have against, the Released
Parties relating to, arising out of or connected in any way with (i) the
Contest, (ii) the awarding or redemption of any prize, and/or (iii) the
determination of the scope or applicability of this agreement to arbitrate,
will be resolved individually and exclusively by final and binding arbitration
administered by the National Arbitration Forum (the "Forum") and
conducted before a sole arbitrator pursuant to the Code of Procedure
established by the Forum. The arbitration shall be held at a location
determined by the Forum pursuant to the Code of Procedure or at such other
location as may be mutually agreed upon by the Entrant and Sponsor. The
arbitrator's decision shall be controlled by the terms and conditions of these
Official Rules and any of the other agreements referenced herein that the
applicable Entrant may have entered into in connection with the Contest. There
shall be no authority for any claims to be arbitrated on a class or
representative basis; arbitration can decide only the Entrant's and/or Sponsor's
individual claims and the arbitrator may not consolidate or join the claims of
other persons or parties who may be similarly situated. The arbitrator shall
not have the power to award special or punitive damages against the Entrant or
Released Parties. For more information on the Forum and/or the Forum's Code of
Procedure, please visit their website at www.arb-forum.com. If any part of this
Arbitration Provision is deemed to be invalid or otherwise unenforceable or
illegal, the balance of this Arbitration Provision shall remain in effect and
shall be construed in accordance with its terms as if the invalid or illegal
provision were not contained herein.
15. PRIVACY POLICY: Any personal information supplied by you
to Sponsor will be subject to Sponsor's privacy policy posted at https://everfi.com/privacy-policy. Sponsor, at its sole
discretion, may share your information with Presenter, which will use such
information in accordance with their respective privacy policy, available at https://www.intuit.com/privacy/. By entering the
Contest, you grant Sponsor permission to share your Submission including your
email address and any other personal information with the other Contest
Entities for the purpose of judging, administration, and prize
fulfillment. Sponsor will not sell, rent, transfer
or otherwise disclose your personal data to any third party other than as
described herein or in accordance with Sponsor's privacy policy.
16.
WINNER LIST:
For the names of the Winners, send your request along with a stamped,
self-addressed envelope to the "Creative Zing – Leading Con Educacion Contest" Winner List, 2100 E Robinson
Street, Orlando, FL 32803. Requests must be received no later than June 30, 2023.

ELEGIBLES MENORES DE 18 AÑOS O QUE NO ALCANCEN LA MAYORÍA DE EDAD DE SU

EN EL MOMENTO DE LA INSCRIPCIÓN EN EL CONCURSO DEBEN OBTENER EL PERMISO DE SUS
PADRES O DE SU TUTOR LEGAL PARA PARTICIPAR. LAS
REGLAS OFICIALES ("REGLAS OFICIALES")
INDICADAS A CONTINUACIÓN CONTIENEN LAS RESTRICCIONES DE ELEGIBILIDAD
ADICIONALES.
1. DESCRIPCIÓN: El concurso "Leading Con Educación" (el "Concurso") ofrece a los participantes elegibles (de manera individual, el "Participante"; colectivamente,
los "Participantes") la oportunidad
de crear y presentar dos
(2) ensayos (de manera
individual, un "Ensayo";
colectivamente, los "Ensayos") inspirados en sus aprendizajes del curso gratuito Simulación de impuestos de TurboTax (el "Curso")
para su consideración según se describe a continuación.
El patrocinador de este Concurso es EVERFI, Inc. ("Patrocinador"), con domicilio en 2300 N Street NW, 4th
Floor, Washington, DC 20037. El presentador de este Concurso es Intuit Inc.
("Presentador").
El administrador de este Concurso es Creative Zing Promotion Group, LLC ("Administrador"),
con domicilio en 2100 E
Robinson Street, Orlando, FL 32803. Se referirá colectivamente al Patrocinador,
al Presentador y al Administrador
como las "Entidades del Concurso". No se podrá participar donde la ley lo prohíba o lo restrinja. Al participar en el Concurso,
cada Participante acepta y acuerda, incondicionalmente, cumplir y observar estas Reglas oficiales y las decisiones de las Entidades del Concurso.
El Concurso se desarrollará
de la siguiente manera:

ESTRUCTURA DEL CONCURSO:
El Concurso consta de dos
(2) grupos de participación
(de manera individual, "Grupo de participación") separados que se determinarán según la categoría del Participante elegible, es decir, estudiante de educación secundaria o estudiante de educación postsecundaria. Hay veinte (20) premios por Grupo de participación (en total, 40 premios para el Concurso).
●
PERIODO DE PRESENTACIÓN: El periodo de
presentación comienza el día viernes, 17 de febrero de 2023 y finaliza a las
11:59:59 p. m. hora del Este ("ET", por sus siglas
en inglés) del domingo 30 de abril de 2023 (el "Periodo de presentación").
●
EXAMINACIÓN, EVALUACIÓN Y VALORACIÓN DE LA PRESENTACIÓN: En simultáneo
con el Periodo de presentación y con posterioridad a este, jurados
seleccionados por las Entidades del Concurso (de manera individual, "Jurado"; colectivamente, "Jurados") examinarán y evaluarán las Presentaciones elegibles (según se define en la Sección 3) de acuerdo
con los criterios estipulados en la Sección 4 de estas
Reglas oficiales.
●
NOTIFICACIÓN A LOS GANADORES: Alrededor del día martes 16 de mayo de
2023, se contactará a un máximo
de veinte (20) Participantes
del Grupo de participación del nivel
secundario y a un máximo de
veinte (20) Participantes
del Grupo de participación del nivel
postsecundario (cada uno de
ellos será un "Ganador" potencial, según lo determinen los resultados de la valoración) para
confirmar su elegibilidad y obtener los descargos, de acuerdo con lo estipulado en la Sección 5
de estas Reglas oficiales.
2. ELEGIBILIDAD DEL
PARTICIPANTE: Para poder
participar en el Concurso y ser considerado Ganador potencial, el Participante
debe cumplir los siguientes criterios de elegibilidad:

El Participante debe ser residente legal de los
EE. UU. y residir físicamente
en alguno de los cincuenta (50) estados de los EE. UU. o en el Distrito de Columbia (o que califique
de acuerdo al programa Acción Diferida para los Llegados en
la Infancia [DACA, por sus siglas en inglés])
y que se identifique como hispano.
o
Grupo de participación del nivel secundario:
En el momento
de la inscripción, el Participante debe tener al menos trece (13) años y ser estudiante actual de educación secundaria (de 9.° a 12.° grado) inscrito en un establecimiento público, privado, parroquial u otra institución; y en caso de ser seleccionado como Ganador potencial, el Patrocinador podrá solicitar una constancia de dicha inscripción que sea satisfactoria para el Patrocinador.
o
Grupo de participación del nivel postsecundario:
En el momento
de la inscripción, el Participante debe ser estudiante actual de educación postsecundaria, tener un máximo de veintiséis (26) años y estar inscrito
en un instituto, una universidad, una escuela de formación profesional u otra institución de enseñanza superior; y en caso de ser seleccionado como Ganador potencial,
el Patrocinador podrá solicitar una constancia de dicha inscripción que sea satisfactoria para el Patrocinador.
●
Para participar,
los Participantes elegibles menores de dieciocho (18) años deben
haber obtenido el permiso de su
padre/madre o tutor legal. Si corresponde, se podrá solicitar al Participante menor que proporcione el consentimiento de su padre/madre o tutor legal de manera satisfactoria para el Patrocinador antes de poder ser declarado Ganador potencial.
●
Este Concurso
no es un evento abierto a funcionarios o empleados gubernamentales ni de departamentos, organismos o dependencias gubernamentales, o
de organizaciones internacionales
públicas. Tampoco pueden participar personas que se
desempeñen en representación oficial o en nombre de tales Gobiernos o departamentos, organismos o dependencias gubernamentales; o en representación oficial o en nombre de tales organizaciones internacionales públicas o instituciones de cualquier jurisdicción, y se rechazará todo Ensayo que haya sido elaborado por dicho funcionario,
empleado o institución.
●
El Participante debe ser el legítimo propietario
de la dirección de correo electrónico identificada en el formulario
de inscripción, o bien debe
estar autorizado a usarla. En el
caso de que surja una disputa sobre
la identidad de un Participante
en el Concurso,
se considerará Participante
al titular autorizado de la cuenta
con la dirección de correo electrónico asociada a la Presentación y dicha persona deberá cumplir con estas Reglas oficiales.
Se define "Titular
autorizado de la cuenta"
como la persona física en cuyo nombre
se abrió la cuenta de correo electrónico. En el caso
de que una disputa en relación con la identidad de un Participante no
se pueda resolver para la conformidad
del Patrocinador, la participación
afectada se podrá considerar no elegible y se seleccionará un Ganador potencial alternativo.
●
El Participante no deberá ser empleado, dueño, accionista, funcionario o
director de las Entidades del Concurso,
del Presentador ni de ninguna compañía matriz, empresa asociada, división, subsidiaria, agente registrado, representante, agencia publicitaria y de promoción de tales Entidades del Concurso y Presentador. Tampoco podrán participar familiares inmediatos y/o convivientes de ninguna de las personas mencionadas
precedentemente (colectivamente,
"Miembros del hogar").
Para los fines del Concurso,
se considerará que "Miembros
del hogar" son aquellas
personas que comparten la misma
residencia al menos durante
tres meses en el plazo de un año; y que "Familiares inmediatos" se refiere a
padre/madre, madrastra/padrastro, tutores legales, hijos, hijastros, hermanos, hermanastros o cónyuges. No se podrá participar donde la ley lo restrinja o lo prohíba.
3. CÓMO PARTICIPAR
Y REQUISITOS PARA LA PRESENTACIÓN: Durante
el Periodo de presentación, el Participante elegible deberá visitar turbotax.everfi.com/tax-simulation/
para completar el Curso. Una vez
completado el Curso, el Participante
deberá seguir las instrucciones en pantalla para completar el formulario de inscripción con su nombre completo, dirección de correo electrónico y establecimiento educativo. A continuación, deberá seguir las instrucciones en pantalla para enviar dos (2) Ensayos y responder correctamente
una (1) pregunta relacionada con el Curso, como se describe en detalle a continuación.
Ensayo uno: El Ensayo debe tener
una extensión mínima de cien (100) palabras y máxima de doscientas cincuenta (250) palabras, y se debe
responder la pregunta a continuación.

¿Qué influyó en
tu interés por el Concurso

clase, actividad o proyecto que se relacione con las

Ensayo dos: El Ensayo debe tener
una extensión mínima de doscientas (200)
palabras y máxima de quinientas
(500) palabras, y se debe responder la pregunta a continuación.

para ti aprender sobre impuestos en la escuela y de qué manera la simulación
de TurboTax te ayudó a sentirte más seguro/a
en cuanto a la presentación de declaraciones de impuestos futuras?

Participante debe responder

¿Cómo se llama uno de los personajes ficticios del Curso?
Para
ser considerado, la pregunta
relacionada con el Curso se debe responder correctamente y el Ensayo debe cumplir
los siguientes requisitos del Ensayo:
●
Los Ensayos deben ser obras propias originales
del Participante y no haber
sido publicadas anteriormente.
●
Los Ensayos deben estar
inspirados en los aprendizajes del Curso.
●
Los Ensayos deben estar
escritos en español o en inglés.
●
Los Ensayos deben ser pertinentes a las preguntas mencionadas anteriormente.
●
Los Ensayos deben cumplir
con los requisitos de extensión mínima y máxima de palabras mencionados anteriormente.
●
Los Ensayos no deben haber ganado ningún
premio o laudo, no se deben haber publicado
anteriormente ni presentado en ningún
otro concurso o promoción.
●
Los Ensayos no deben incluir temas que sean obscenos, pornográficos, violentos, difamatorios, calumniosos, ilegales, ofensivos, amenazantes, profanos o que promuevan el odio,
la discriminación o el acoso; que resulten degradantes, inaceptables o ilícitos de algún modo, o que las
Entidades del Concurso, a su exclusivo criterio,
pudieran considerarlos de esa manera.
●
Los Ensayos no deben incluir material que infrinja o viole alguna ley o reglamentación aplicable, o algún derecho de un tercero, incluidos: (1) patentes, secretos comerciales u otros derechos contractuales o de
propiedad; (2) el derecho
de privacidad o publicidad;
o (3) cualquier obligación
de confidencialidad.
●
Los Ensayos no deben incluir ninguna referencia que perjudique a las Entidades del Concurso o a cualquiera de sus compañías
matrices, o a cualquiera de sus productos
o servicios.
Nota: Las Entidades del Concurso se reservan el derecho, a su exclusivo criterio,
de descalificar todo Ensayo que viole los requisitos del Ensayo o que potencialmente infrinja o viole de algún modo derechos de un tercero,
o bien si se considera inaceptable de alguna manera o que carece de buen gusto o calidad.
El formulario de inscripción
completado, los Ensayos y la respuesta a la pregunta relacionada con el Curso serán
referidos colectivamente como la "Presentación". TODAS
LAS PRESENTACIONES SE DEBEN RECIBIR ANTES DEL DOMINGO 30 DE ABRIL DE 2023 A LAS
11:59:59 P. M. ET. EL LÍMITE ES DE UNA (1) PRESENTACIÓN POR
PARTICIPANTE. Cualquier intento
de realizar más de una Presentación podrá ocasionar la descalificación del Concurso. Las
Presentaciones incompletas,
ilegibles o ininteligibles
se descalificarán. LOS PARTICIPANTES ELEGIBLES DEBEN
INGRESAR AL CONCURSO DE ACUERDO CON ESTAS REGLAS OFICIALES. NO SE ACEPTARÁ
NINGÚN OTRO MÉTODO DE PRESENTACIÓN. La participación en el Concurso
implica que el Participante acepta estas Reglas oficiales
y está de acuerdo con ellas de manera total e incondicional. El Patrocinador se
reserva el derecho de descalificar a todo Participante que determine que viola algún
término incluido en estas Reglas
oficiales. La decisión del Patrocinador de no aplicar una disposición específica de estas Reglas oficiales no constituye una exención de esa disposición ni de las Reglas oficiales en general.
4. EXAMINACIÓN Y
VALORACIÓN DE LA PRESENTACIÓN:
En simultáneo con el Periodo de presentación
y con inmediata posterioridad
a este, representantes
de las Entidades del Concurso
("Jurados") examinarán
y valorarán las Presentaciones
elegibles de cada Grupo de participación en función de los criterios y las ponderaciones que
se mencionan a continuación
("Criterios de valoración").
Hasta veinte (20) Presentaciones
elegibles para cada Grupo
de participación con las puntuaciones
más altas se determinarán como Ganadores potenciales, con sujeción a la verificación de la elegibilidad, la formalización de
los Documentos de reclamación del premio y en cumplimiento con las Reglas oficiales.
●
Qué tan pertinente es al Curso y a las preguntas relacionadas con el Curso: 50 %
●
Originalidad/creatividad: 25 %
●
Clara expresión
de la idea/gramática correcta: 25 %
En
el caso de existir un empate dentro de un Grupo de participación, se volverán a evaluar los Ensayos
asociados con las Presentaciones
empatadas de acuerdo con los criterios definidos
anteriormente para determinar
a los Ganadores potenciales. En el caso de que se reciba una cantidad
insuficiente de Presentaciones
elegibles, las Entidades
del Concurso se reservan el derecho de seleccionar a menos de veinte (20) Ganadores potenciales por Grupo de participación y/o de
prolongar el Periodo de presentación y prorrogar todas las demás fechas asociadas
con el Concurso, según lo determinen las Entidades del Concurso y a su exclusivo criterio.
Todas las decisiones del
Panel de valoración son definitivas
en todos los aspectos del Concurso. No se revelarán las puntuaciones de valoración ni se anunciarán públicamente.
5. NOTIFICACIÓN A LOS GANADORES:
Alrededor del martes 16 de mayo de 2023, se notificará mediante la dirección de correo electrónico proporcionada en ocasión del ingreso al Concurso a un máximo de cuarenta (40) Ganadores potenciales, según lo determinen los resultados de valoración. Cada Ganador potencial
(o su padre/madre o tutor
legal, en caso de ser menor de edad) deberá verificar su domicilio legal y permanente; proporcionar una constancia de inscripción en un establecimiento educativo de nivel secundario o postsecundario, y completar una declaración jurada de elegibilidad, una exención de responsabilidad y, a menos que lo
prohíba la ley, una cesión de derechos de publicidad,
junto con otros documentos
(colectivamente, "Documentos
de reclamación del premio"),
según lo requieran las Entidades del Concurso a su exclusivo criterio,
para contemplar cuestiones referidas a elegibilidad, alcances de responsabilidad, publicidad y presencia en medios de comunicación.
El incumplimiento por parte del Ganador potencial (o su padre/madre o tutor legal, en caso de ser menor de edad) de entregar los Documentos de reclamación del premio en el plazo
especificado puede ocasionar la pérdida de derechos sobre el premio
y la selección de un Ganador
alternativo para el Grupo de participación
correspondiente según los resultados de la valoración. No se entregará/concretará ningún premio hasta tanto no se entreguen
todos los documentos correctamente formalizados. Las Entidades del Concurso, a su exclusivo criterio, intentarán contactar con hasta tres (3) Ganadores potenciales de cada premio de acuerdo con el procedimiento descrito anteriormente, luego de
lo cual el premio en cuestión
podrá no entregarse si ninguno de ellos
lo reclama. Las Entidades del Concurso
se reservan el derecho de descalificar a quien no cumpla en su
totalidad con las Reglas oficiales. El Ganador debe proporcionar
a las Entidades del Concurso
su número de Seguro Social
a los fines del reporte de impuestos antes de que se entregue
el premio. Cada Ganador recibirá
un Formulario 1099 del IRS (Servicio
de Impuestos Internos) por el valor total
del premio recibido para el año de obtención
del premio.
6. PREMIOS: Hay
veinte (20) premios por Grupo de participación, (en total, 40), según se describe
a continuación.
Premios
(20 por Grupo de participación/40 en total): Una (1) tarjeta de regalo para un plan 529 de Gift of College
por una cantidad
de dos mil quinientos dólares estadounidenses ($2500.00).
TODOS LOS IMPUESTOS FEDERALES, ESTATALES
Y LOCALES, JUNTO CON CUALQUIER OTRO COSTO O GASTO, ASOCIADOS CON LA RECEPCIÓN O
EL USO DEL PREMIO SON EXCLUSIVA RESPONSABILIDAD DEL GANADOR. No se permite a los Ganadores
asignar, transferir o
vender la reclamación del premio
a ninguna otra persona. Queda prohibido reemplazar el premio,
excepto así lo decidan las Entidades del Concurso. Límite de un (1) premio por persona/por hogar.
Las Entidades del Concurso coordinarán la entrega del premio directamente con el Ganador (o su padre/madre o tutor legal, en caso de ser menor de edad). Si el Ganador

de regalo para un plan 529 de Gift of College están sujetas a sus propios términos, disponibles en www.giftofcollege.com/purchasegiftcard/. Se pueden aplicar otras restricciones.
7. CONDICIONES DE
PARTICIPACIÓN/DESCARGOS: El Concurso
es nulo donde la ley lo prohíba o lo restrinja. Se aplican todas las leyes y las reglamentaciones
federales, estatales y locales. Al participar, cada Participante (y, en caso de tratarse de un menor de edad, el padre/la madre o el tutor legal en su nombre) acepta
atenerse a estas Reglas oficiales
y a las decisiones de las Entidades
del Concurso, las que serán
decisivas en todos los aspectos.
Al participar en este Concurso y/o al aceptar cualquier premio que pueda ganar, cada Participante
(y, en caso de tratarse de un menor de edad, su padre/madre o tutor legal en su nombre) acepta
exonerar a las Entidades
del Concurso, al Presentador
y a sus respectivas empresas
asociadas, divisiones, subsidiarias, empresas sucesoras, cesionarios y licenciatarios, y a cada uno de
sus respectivos empleados, accionistas, funcionarios, directivos, contratistas, agencias de publicidad y promoción, agentes y representantes (colectivamente,
las "Partes exoneradas")
de toda acción, reclamación, agravio, pérdida o daño resultante, de manera directa o indirecta, de la participación en este Concurso y/o de la aceptación o el uso de cualquier premio. Cada Participante
(y, en caso de tratarse de un menor de edad, el padre/la madre o el tutor legal en su nombre)
autoriza a las Entidades
del Concurso a usar su Presentación, sus Ensayos, su nombre, su
voz, su imagen, sus datos biográficos, su ciudad y estado de residencia,
y los materiales de ingreso en los
materiales promocionales o
de programación, en todo el mundo
y a perpetuidad, o en una lista de ganadores,
si corresponde, sin derecho
a recibir compensación alguna, a menos que lo prohíba la ley. Las Entidades del
Concurso no tienen la obligación de usar ninguno de los materiales ni la información mencionados anteriormente, pero podrán hacerlo
y podrán editarlos, a su exclusivo criterio,
sin tener que efectuar compensación alguna ni cumplir con ninguna otra obligación.
Las Partes exoneradas no serán responsables en los siguientes
casos: (i) entradas, formularios
de descargo, comunicaciones
o declaraciones jurados demorados, extraviados, retrasados, dañados, robados, mal dirigidos, con franqueo a pagar, incompletos, ilegibles, imprecisos, incomprensibles o ininteligibles, independientemente
del método de transmisión;
(ii) demoras o errores de transmisión, desconexiones, conexiones perdidas o desperfectos informáticos, técnicos o de otro tipo en sistemas
telefónicos, teléfonos o
software o hardware informático;
(iii) daño, robo o destrucción de datos, acceso no autorizado a ellos o alteración de entradas u otros materiales; (iv) todos y cada uno de los daños, pérdidas,
derechos, reclamaciones y acciones
de cualquier tipo en conexión con la participación en el Concurso o resultantes
de esta; (v) aceptación, posesión, otorgamiento o uso de cualquier premio o evento relacionado con él, o participación en él, incluidos, entre otros, lesiones personales, muerte y daños a la propiedad resultantes de ellos; (vi) reclamaciones basadas en derechos de publicidad, difamación o invasión de la privacidad; o (vii) todo error de
impresión, tipográfico, tecnológico o administrativo humano en los
materiales asociados al Concurso. Las Entidades del Concurso declinan toda responsabilidad por daños a cualquier
sistema informático resultantes de la participación, el acceso o
la descarga de información en conexión con este Concurso. El Patrocinador se reserva el derecho, a su exclusivo criterio, de cancelar, modificar o suspender el Concurso (o cualquier sección de este) en caso
de que algún virus, error o problema
informático, intervención
no autorizada u otra causa
o problema dañaran o inhibieran la administración, la seguridad o el adecuado desarrollo del Concurso y, en tal situación, de seleccionar a los ganadores a partir de los resultados de la valoración o de todas las
entradas elegibles libres
de sospecha recibidas con anterioridad y/o posterioridad a tal acción o de tal manera que el Patrocinador considera justa y apropiada. El Patrocinador podrá prohibir la participación en el Concurso o el
otorgamiento de un premio a
un Participante si, a su exclusivo criterio,
determina que el Participante intenta desvirtuar el funcionamiento
legítimo de este Concurso mediante engaño, piratería, decepción o cualquier otra práctica de participación desleal o pensada para molestar, abusar, amenazar o acosar a otros participantes o a los representantes del Patrocinador.
PRECAUCIÓN: TODO INTENTO DELIBERADO DE DAÑAR EL SITIO WEB O DE DESVIRTUAR EL
FUNCIONAMIENTO LEGÍTIMO DEL CONCURSO PUEDE CONSTITUIR UNA VIOLACIÓN DE LAS
LEYES CIVILES Y PENALES, Y OCASIONARÁ LA DESCALIFICACIÓN DEL CONCURSO. SI SE
REALIZA TAL INTENTO, EL PATROCINADOR SE RESERVA EL DERECHO DE RECLAMAR DAÑOS Y
PERJUICIOS (INCLUIDOS LOS HONORARIOS DE ABOGADOS) CON EL MÁXIMO ALCANCE QUE
PERMITA LA LEY, LO CUAL INCLUYE ACCIONES PENALES.
8. EXIMICIÓN: El
Ganador (y, en caso de tratarse de un menor de edad, el padre/la madre o el tutor legal en su nombre) eximirá,
defenderá y liberará de toda responsabilidad a las Partes exoneradas de todos y cada uno de los daños, las reclamaciones, las acciones, las responsabilidades, las pérdidas,
las lesiones o los gastos, incluidos los honorarios y los honorarios razonables de abogados, que surjan
como resultado de las siguientes situaciones o en conexión con ellas: (a) la participación en el Concurso;
(b) el incumplimiento o la acusación que, en caso de ser ciertos, constituirían una infracción de cualquier representación, garantía u obligación por parte del Ganador
según el presente documento; y (c) la aceptación, la posesión, el otorgamiento, la participación o el uso de cualquier premio, incluidos, entre ellos, lesiones personales, muerte y daños a la propiedad resultantes de estos.
9. GARANTÍAS Y DECLARACIONES DE
LA PRESENTACIÓN: Cada
Participante (y, en caso de tratarse de un menor de edad, el padre, la madre o el tutor legal en su nombre) declara
y garantiza lo siguiente:
(i) que la Presentación es una
obra propia original del Participante que no ha sido producida ni publicada
anteriormente; y (ii) que la Presentación
no viola ninguna ley aplicable
y que no es difamatoria, injuriosa
o calumniosa, ni ahora ni en
el futuro. Cada Participante (y, en caso de tratarse
de un menor de edad, el padre/la madre o el tutor legal en su nombre) acepta
eximir y liberar de responsabilidad a las Partes exoneradas de todas y cada una de las reclamaciones, las acciones o los procesos de cualquier tipo de terceros, y de todos y cada uno de los daños, las responsabilidades, los costos y los
gastos relacionados con cualquier infracción supuesta o real, o que surjan de esta, de alguna de las garantías, representaciones o acuerdos del Participante mediante el presente
documento.
10. OTORGAMIENTO DE DERECHOS: Cada
Participante (y, en caso de tratarse de un menor de edad, el padre/la madre o el tutor legal en su nombre) del Concurso mediante el presente documento
les otorga de manera
irrevocable a las Entidades del Concurso,
sus apoderados, empresas subsidiarias, empresas sucesoras y cesionarios la licencia universal, completamente
pagada, no exclusiva e
irrevocable para usar, copiar, sublicenciar,
transmitir, distribuir, interpretar públicamente, publicar, eliminar o exhibir la Presentación por cualquier medio de comunicación conocido ahora o concebido en el futuro,
incluidas, entre ellas, todas las formas de soporte electrónico, medios impresos y todas las formas de protocolos de Internet e inalámbricos
en cualquier lugar del universo y a perpetuidad con fines publicitarios,
de marketing y promocionales en
conexión con el Concurso y otras promociones. El Patrocinador tendrá el derecho, a su exclusivo criterio,
de editar, componer, transformar, escanear, duplicar o alterar la Presentación con cualquier propósito que considere necesario o deseable, y cada Participante irrevocablemente renuncia a todos y cada uno de los derechos denominados morales que pueda tener en ese respecto.
11. NATURALEZA DE
LA RELACIÓN/RENUNCIA A REPARACIÓN EQUIPARABLE: Cada
Participante y Ganador (y, en caso de tratarse
de un menor de edad, el padre/la madre o el tutor legal en su nombre) comprende
y reconoce que las Entidades del Concurso tienen amplio acceso
a ideas, diseños y otros materiales, y que, en este momento, sus propios empleados, proveedores y/o socios comerciales desarrollan nuevas ideas. Cada Participante y Ganador (y, en caso de tratarse
de un menor de edad, el padre/la madre o el tutor legal en su nombre) también
reconoce que muchas ideas pueden entrar en
competencia, similitud o parecido exacto con una idea y/o tema, formato u otros aspectos, y acepta que no presentará ninguna reclamación o acción contra ninguna de las Entidades del Concurso ni ningún tercero
y que no tendrá derecho a recibir
ninguna compensación como resultado de que alguna de las Entidades del Concurso o algún tercero haga uso
de tal material similar o idéntico.
Cada Participante y Ganador reconoce y acepta que las Entidades del Concurso no tienen ahora ni tendrán
en el futuro
ninguna obligación o responsabilidad, directa o indirecta, por falta ajena, contributiva
o de otro tipo respecto a la violación o protección de derechos de autor, patente, secreto comercial, derechos propietarios
u otros derechos de propiedad
intelectual en relación con una idea y/o la Presentación. Nada de lo estipulado
en el presente
documento se debería interpretar para crear algún tipo de relación
de empleo, relación
contractual, asociación o empresa
conjunta con ninguna de las
Entidades del Concurso.
12. LEY APLICABLE: TODOS LOS PROBLEMAS Y LAS PREGUNTAS
SOBRE LA CONSTRUCCIÓN, LA VALIDEZ, LA INTERPRETACIÓN Y LA FUERZA EJECUTORIA DE
ESTAS REGLAS OFICIALES O DE LOS DERECHOS Y LAS OBLIGACIONES DE LOS
PARTICIPANTES O DE LAS ENTIDADES DEL CONCURSO EN CONEXIÓN CON EL CONCURSO O CON
ALGUNA PRESENTACIÓN U OTRO MATERIAL PRESENTADO EN RELACIÓN CON TAL CONCURSO SE
CONTROLARÁN E INTERPRETARÁN DE ACUERDO CON LAS
13. DISPUTAS:
Como condición para participar
en este Concurso,
los Participantes aceptan que todas y cada una de las disputas que no se puedan resolver
entre las partes y todas y cada una de las causales de acción emergentes de este Concurso o en relación
con él se resolverán de manera individual, sin recurrir a
ningún tipo de demanda colectiva o consolidada, de acuerdo con la disposición de arbitraje que se menciona a continuación. Además, en caso
de ocurrir una disputa, en ninguna
circunstancia se les permitirá
a los Participantes (y, en caso de tratarse
de un menor de edad, al
padre/la madre o el tutor
legal en su nombre) obtener recompensas por otros gastos que no sean desembolsos varios reales, de existir, (p. ej., los costos asociados
con la participación en el Concurso), y mediante el presente
documento, los Participantes renuncian a todo derecho a presentar reclamaciones por daños punitivos, incidentales o derivados, incluidos, entre ellos, los honorarios de abogados, además de renunciar a todo derecho a que se multipliquen
o aumenten los daños y perjuicios.
14. DISPOSICIÓN DE ARBITRAJE: Al participar en este Concurso,
cada Participante (y, en caso de tratarse
de un menor de edad, el padre/la madre o el tutor legal en su nombre) acepta
que todas y cada una de las disputas que pueda tener con las Partes exoneradas o que todas y cada una
de las reclamaciones que pueda
tener contra estas derivadas de alguna manera (i) del Concurso, (ii) del
otorgamiento o canje de algún premio, y/o (iii) de la determinación del alcance o la aplicabilidad de este acuerdo de arbitraje, o que guarden relación con alguno de estos, se resolverán de manera individual y exclusiva mediante un arbitraje definitivo y obligatorio administrado por el National Arbitration Forum (Foro
Nacional de Arbitraje) (el
"Foro") de los
EE. UU., que tendrá lugar
ante un único árbitro en virtud del Código de Procedimientos establecido por el Foro.
El arbitraje se realizará en la ubicación que determine el Foro conforme
el Código de Procedimientos
o en la ubicación que el Participante y el Patrocinador dispongan de mutuo acuerdo. La decisión del árbitro será consonante
con los términos y condiciones de estas Reglas oficiales y de cualquier otro acuerdo indicado en el presente
documento en el cual el
Participante se haya involucrado en conexión con el Concurso. No habrá autoridad arbitral para dirimir reclamaciones colectivas o representativas; el proceso de arbitraje puede decidir únicamente
las reclamaciones individuales
del Participante y/o el Patrocinador, y el árbitro no podrá consolidar o vincular las reclamaciones de otras partes o personas físicas que puedan estar en
una situación similar. El árbitro no tendrá la potestad de fijar daños especiales o punitivos contra el Participante o las Partes exoneradas. Para obtener más información sobre el Foro
y/o el Código de Procedimientos
del Foro, visita su sitio web en
www.arb-forum.com. Si alguna parte
de esta Disposición de Arbitraje se considera nula o de algún modo inaplicable o ilegal, el contenido restante de tal Disposición mantendrá su vigencia
y se interpretará de acuerdo
con sus términos como si la sección nula
o ilegal no se incluyera en ella.
15. POLÍTICA DE PRIVACIDAD:
Toda información personal que hayas
proporcionado al Patrocinador
estará sujeta a la política de privacidad del Patrocinador publicada en https://everfi.com/privacy-policy.
El Patrocinador, a su exclusivo criterio, podrá compartir tu información con el Presentador, quien usará tal
información de acuerdo con su respectiva política
de privacidad, disponible en
https://www.intuit.com/privacy/.
Al participar en el Concurso, le otorgas permiso al Patrocinador para que comparta tu Presentación, incluida tu dirección
de correo electrónico y cualquier otra información personal, con las otras
Entidades del Concurso con el propósito de valorar, administrar y entregar el premio. El
Patrocinador no venderá, alquilará, transferirá ni divulgará de otro modo tus datos
personales a ningún tercero, excepto lo descrito al respecto en el presente
documento o de acuerdo con
la política de privacidad
del Patrocinador.
