Guidelines

1. DESCRIPTION: The New York Lottery Mets Bullpen Jackpot Promotion (the
“Promotion") registration begins
on Monday, April 4, 2022, at 12:00:01 am Eastern Time (“ET”) and ends when sixteen (16) Jackpot Prizes (as described below)
are awarded or at 11:59:59 pm ET on Tuesday, September 27, 2022, whichever
comes first (the “Promotion Period”). The Promotion Period is separated into ten (10) drawing periods (as
described in the Drawing Chart below). For each New
York Mets[1]
(“Mets”) Home Baseball Game played
on the ‘Game Dates’ set forth in the Drawing Chart, below, (each a
“Game”), one (1) Entrant (as defined
in Section 2) will be randomly selected as the potential Fan of the Game Jackpot
Finalist (each a “Jackpot Finalist” as defined in Section 4) for
the applicable Game, subject to verification of eligibility and compliance with
these Official Guidelines, and he or she will have the opportunity to win the Mets
Bullpen Jackpot Prize (the “Jackpot
Prize”) for the applicable Game if a Qualifying Play (as defined in Section
6) occurs in such Game. If a Qualifying Play does not occur in the applicable
Game and the Jackpot Prize is not awarded, a consolation prize (the “Runner-Up Prize”) shall be awarded to the
Jackpot Finalist for such game, and the Jackpot Finalist shall also be entered
into a Grand Prize drawing at the conclusion of the Promotion Period, which
shall award one Grand Prize to one of up to eighty-one (81) Jackpot Finalists who
did not win a Jackpot Prize. The
sponsor of this Promotion is the New York State Gaming Commission (“Sponsor”),
operator of the New York Lottery, One Broadway Center, Schenectady, NY 12305. The
administrator of this Promotion is Creative Zing Promotion Group ("Administrator"), 2100 E Robinson
Street, Orlando, FL 32803. The host of the Promotion is Sterling Entertainment
Enterprises, LLC d/b/a SportsNet New York (“Host” or “SNY”), 4 World
Trade Center, 150 Greenwich Street, 49th Floor, New York, NY 10007. The Sponsor, Administrator and Host shall
collectively be referred to as the “Promotion
Entities”. This Promotion is in no way sponsored, administered,
offered, executed or produced by Sterling Mets L.P. (“Promotional Partner” or “NY Mets”),
the other “MLB Entities” (as defined below) or any of their respective
affiliates, officers, directors, agents and
employees. SNY is responsible for hosting only; SNY is in no way responsible
for the administration or fulfillment of the Promotion.
2. ELIGIBILITY: The Promotion is open only to legal U.S. residents physically
residing in New York, New Jersey, Connecticut or Pennsylvania who are at least
eighteen (18) years of age at the time of entry (“Entrant”). Employees,
shareholders, officers, directors, agents, and representatives of Promotion
Entities, NY Mets, the MLB Entities, and each of their affiliates and each of
their respective employees, shareholders, officers, directors, members,
successors, agents and assigns, together with any spouse, child, brother,
sister, or parent residing as a member of the same household in the principal
place of abode of any of the foregoing persons, are not eligible to participate
in the Promotion. The “MLB Entities”
shall mean the Office of the Commissioner of Baseball (“BOC”), its
Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (MLBAM
or MLB.com), Major League Baseball Properties, Inc., The MLB Network,
LLC, the Major League Baseball Clubs (“Clubs”), each of their parent,
subsidiary, affiliated and related entities, any entity which, now or in the
future, controls, is controlled by, or is under common control with the Clubs
or the BOC, and the owners, general and limited partners, shareholders,
directors, officers, employees and agents of the foregoing entities. VOID
OUTSIDE OF NEW YORK, NEW JERSEY, CONNECTICUT AND PENNSYLVANIA AND WHERE
PROHIBITED OR RESTRICTED BY LAW.
3. HOW TO PARTICIPATE: Entrants may participate by
visiting https://sny.tv/newyorklottery (“Website”) during the Promotion
Period and following the on-screen instructions to completely and accurately
complete the registration form including providing each Entrant’s first name,
last name, mailing address, daytime phone, and email address. Entrants are
required to affirmatively accept these Official Guidelines. Upon successful completion of the
registration form, the Entrant will receive
one (1) entry into the Promotion. The Entrant
must be the rightful owner (or have authorized use) of the email address
identified on the registration form. In the event of a dispute over the
identity of an Entrant, the authorized account holder of the email address
associated with the entry shall be deemed to be the Entrant, as long as such
individual is otherwise eligible and in compliance with these Official Guidelines.
“Authorized Account Holder” is
defined as the natural person in whose name the email account was opened. In the event a dispute regarding
the identity of an Entrant cannot be resolved to Sponsor’s satisfaction, the
affected entry may be deemed ineligible, and
an alternate potential Jackpot Finalist will be
selected by random drawing from among all remaining eligible entries
received as of the applicable Entry Deadline. Entries must be received in
accordance with the Drawing Chart below.

Limit one (1) entry per person, per day during the Promotion
Period. For purposes of these Official Guidelines,
a “day” is defined as any twenty-four (24) hour period during the Promotion
Period beginning at 12:00:01 am ET and ending at 11:59:59 pm ET on the same
date. Non-winning entries will carry
forward to each subsequent drawing. If
an Entrant exceeds the entry limitations, the Entrant may be disqualified, at
the Sponsor’s sole discretion. Entries generated by a script, macro or other
automated means will be disqualified.
Entrants must accurately provide all of the requested
information to be eligible to win. Incomplete, unreadable, or unintelligible
entries will be disqualified. All
information provided by Entrants becomes the property of Sponsor. ELIGIBLE
ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL GUIDELINES. NO OTHER METHOD OF
SUBMISSION WILL BE ACCEPTED.
Participation in the Promotion constitutes Entrant's full and unconditional
agreement to, and acceptance of, these Official Guidelines. Sponsor reserves
the right to disqualify any Entrant that Sponsor determines to be in violation of any provision of these
Official Guidelines. Sponsor’s decision not to enforce a specific provision of
these Official Guidelines does not constitute a waiver of that provision or of the Official Guidelines generally.
4. RANDOM DRAWINGS & GAME ASSIGNMENTS: For each Drawing Period, one (1)
potential Jackpot Finalist per Game shall
be selected at random from among all eligible entries received in accordance with the Drawing Chart above
(each a “Jackpot Finalist”). Pending
confirmation of eligibility, each potential Jackpot Finalist will be assigned to the specific Game for which
he or she was drawn, which shall correlate to the potential Jackpot Prize for
such Game. Should a Game be postponed or
rescheduled, the potential Jackpot Finalist assigned to the originally
scheduled Game will be reassigned to the
rescheduled Game. The Jackpot associated with the originally scheduled Game will
be the applicable Jackpot on the rescheduled Game date. Example: If the Jackpot
amount for the originally scheduled Game was $10,000; the same $10,000 Jackpot
will remain in effect on the rescheduled Game date (regardless of the current Jackpot
amount). Should a Game be cancelled and not re-scheduled, the Jackpot
Finalist shall be awarded the Runner-Up Prize, as described in Section 8. On or about October 6, 2022, one (1) potential
Grand Prize winner shall be selected by random drawing from among up to
eighty-one (81) Jackpot Finalists, who did not win a Jackpot Prize.
5. NOTIFICATION: Potential Jackpot
Finalists shall be notified by email and/or telephone and shall be required to
respond within twenty-four (24) hours of first attempted notification (or a
shorter time if deemed appropriate due to exigencies).
The Promotion Entities and the MLB Entities shall have no liability for any
such notification that is lost, intercepted, or not received by a potential Jackpot
Finalist. Each potential Jackpot Finalist must be able to receive telephone
calls from an unlisted and/or blocked number. If a potential Jackpot Finalist
does not answer such telephone call, a message might not be left for the
Jackpot Finalist. Promotion Entities reserve the right to disqualify any
Entrant and/or potential Jackpot Finalist who does not fully comply with these
Official Guidelines. In order for a potential Jackpot Finalist to be confirmed
as a Jackpot Finalist, he or she is required to verify his or her address and
return within twenty-four (24) hours (or a shorter time if deemed appropriate
due to exigencies) an acceptable affidavit of eligibility and a liability/publicity
release (collectively,
“Participation Agreement”) in a format to be provided to the potential Jackpot Finalist by the Promotion
Entities, covering eligibility, liability, advertising, publicity and media appearance
issues, unless prohibited by law. Failure
of a potential Jackpot Finalist to respond to the notification or return the
executed Participation Agreement within the specified time period may result in
disqualification of the entry and forfeiture of any opportunity to win a prize,
and an alternate Jackpot Finalist may be selected from the remaining eligible
entries received as of the applicable Entry Deadline through the corresponding Drawing
Period. In the event the Jackpot Prize
(as described below) is awarded, the potential Jackpot Prize winner will be
notified within ten (10) days of the date when the Qualifying Play (as defined
below) occurred. Any potential
Jackpot Prize or Grand Prize winner will be required to provide his/her Social
Security Number or Taxpayer ID for taxation purposes and complete a “Prize
Acceptance Form” to claim the Jackpot Prize or Grand Prize, respectively.
Should a Social Security Number or Taxpayer ID not be provided, taxes will be
withheld from each such prize pursuant to the tax withholding rates established
by the Internal Revenue Service and the New York State Department of Taxation
and Finance. An IRS Form 1099 will be issued in the name of any Jackpot Prize
winner and the name of the Grand Prize winner for the total amount of the prize
respectively received. Both the Jackpot Prize and the Grand Prize are taxable
as income, and all taxes associated with a prize (including but not limited to
income taxes) are the sole responsibility of any winner. If applicable, Runner-up Prizes will be
mailed to the recipients at the mailing address provided on the Participation
Agreement within approximately four (4) weeks of their assigned Game.
6. QUALIFYING PLAY: During
the Promotion Period and in the bottom of any inning of a Game, a batting New York Mets player must hit a fly home run that either hits the
New York Lottery Mets Bullpen Jackpot sign or otherwise lands within the visiting
team’s bullpen (the “Qualifying Play”).
If the ball makes contact with the ground or another
object prior to hitting the New York Lottery Mets Bullpen Jackpot sign or
landing within the visiting team’s bullpen, such play will not be a
Qualifying Play. The New York Mets are
the official scorekeepers of the Game and will determine how a play is scored. In
the event of a Qualifying Play, the Administrator will review the available
game video footage to validate that such Qualifying Play did occur; validation
may take up to ten (10) days, and prize fulfillment may take up to forty-five (45)
days. All decisions by the Administrator are final.
7. ODDS OF WINNING: The odds of being selected as a potential Jackpot Finalist
depend on the number of eligible entries received as of the applicable Entry Deadline,
and the odds of winning a Jackpot Prize or Runner-Up Prize depend on whether a
Qualifying Play occurs in the applicable Game.
The odds of a Jackpot Finalist being selected as the Grand Prize winner are
up to 1:81.
8. PRIZES:
Jackpot Prizes (*Up to16 available) *Contingent on a Qualifying Play |
The Jackpot Prize will be awarded ONLY if
a Qualifying Play occurs, as described in Section 6. In the event of a Qualifying Play, the
winner assigned to the Game in which the Qualifying Play occurred will
receive one (1) Jackpot Prize. The jackpot amount will start at Ten Thousand
Dollars ($10,000). If the Jackpot Prize goes unawarded in a Game, the Jackpot
Prize will rollover to the next Game and increase by One Thousand Dollars ($1,000).
The Jackpot Prize will continue to increase in increments of $1,000 for each
Game that does not include a Qualifying Play.
If a Qualifying Play occurs in a Game and the Jackpot Prize is
awarded, the Jackpot Prize will reset to $10,000 for the next Game and continue
to increase in increments of $1,000 for each Game that does not include a
Qualifying Play, as described above. Jackpot Prizes, if any, will be awarded
in the form of a check in the amount equal to the Jackpot Prize for their corresponding
Game. Limit one (1) Jackpot Prize per
Game, regardless of the number of Qualifying Plays that may occur in such
Game. |

FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED
WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF EACH
INDIVIDUAL WINNER. The gift cards are subject to separate terms and conditions,
as detailed on such gift card. Prize winners cannot assign or transfer any
prize to another person. No cash or prize substitution is allowed except at the
discretion of Promotion Entities. If a prize cannot be awarded due to
circumstances beyond the control of the Promotion Entities, a substitute prize
of equal or greater retail value may be awarded. The prizes are awarded without
warranty of any kind, express or implied, without limitation. If prizes are
awarded but are unclaimed or forfeited by the recipient, the prize may not be
re-awarded, in the Promotion Entities’ sole discretion. Other restrictions may
apply.
9. CONDITIONS OF PARTICIPATION/RELEASES:
The Promotion is subject to applicable federal, state and local laws and
regulations. By participating, each
Entrant agrees to be bound by these Official Guidelines and the decisions of
the Promotion Entities and New York Mets, which shall be final in all respects.
By participating in this Promotion and/or by accepting any prize, each Entrant agrees
to release and indemnify the Promotion Entities, the New York State Gaming
Commission, New York Mets, the MLB Entities; each of their respective parent,
subsidiary and affiliated companies, units and divisions and advertising and
promotional agencies and prize suppliers; each of their respective officers,
directors, agents, representatives and employees; and each of these companies
and individuals' respective successors, representatives and assigns
(collectively, the "Released
Parties") from any and all actions, claims, injury, loss or damage
arising, or alleged to have arisen, in any manner, directly or indirectly, from
participation in this Promotion and/or acceptance, use, or misuse of any prize.
Each Entrant, as a condition of receiving a prize, authorizes the Sponsor, Administrator,
Host, New York Mets and their designees to use his/her name, photograph, voice,
likeness, biographical data, city and state of residence in programming or
promotional material, throughout the universe in perpetuity, or on a winner's
list, if applicable, without further compensation unless prohibited by law. By entering the Promotion, Entrants
agree that: (1) any and all disputes, claims, and causes of action arising out
of or connected with the Promotion, or any prizes awarded, shall be resolved
individually, without resort to any form of class action; (2) any and all
claims, judgments and awards shall be limited to actual out‑of‑pocket
costs incurred, including costs associated with entering the Promotion, but in
no event will Entrant’s attorneys’ fees be awarded or recoverable; and (3)
under no circumstances will any Entrant be permitted to obtain any award for,
and Entrant hereby knowingly and expressly waives all rights to seek, punitive,
incidental or consequential damages and/or any other damages, other than actual
out‑of‑pocket expenses, and/or any and all rights to have damages
multiplied or otherwise increased. The
Released Parties shall not be liable for: (i) late, lost, delayed, stolen,
misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or
unintelligible entries, communications or affidavits, regardless of the method
of transmission; (ii) telephone system, telephone or computer hardware,
software or other technical or computer malfunctions, lost connections,
disconnections, delays or transmission errors; (iii) data corruption, theft,
destruction, unauthorized access to, or alteration of, entry or other
materials; (iv) any injuries, losses or damages of any kind caused by the prize
or resulting from acceptance, possession, use or misuse of a prize, or from
participation in the Promotion; (v) the Entrant’s claim that he or she has somehow been
defamed or portrayed in a false light or (vi) any
printing, typographical, human administrative or technological errors in any
materials associated with the Promotion. Promotion Entities and the MLB Entities assume no
responsibility for any damage to an Entrant’s computer system, which is
occasioned by visiting the Website, or participating in the Promotion, or for
any computer system, phone line, hardware, software or program malfunctions, or
other errors, failures, delayed computer transmissions or network connections
that are human or technical in nature, or for the incorrect or inaccurate
capture of information, or the failure to capture any information.
Promotion Entities reserve the right, in their sole discretion, to cancel,
modify or suspend the Promotion (or any portion of the Promotion) should an
epidemic, pandemic, act of nature, virus, bug, computer problem, unauthorized
intervention or other cause or problem corrupt or inhibit the administration,
security or proper play of the Promotion. In such situation, Promotion
Entities, in their sole discretion, reserve the rights to select the potential grand
prize winner from among all eligible non-suspect entries received prior to
and/or after such action or in such manner as deemed random, fair and
appropriate by the Promotion Entities. Promotion
Entities may prohibit you from participating in the Promotion or winning a
prize if, in their sole discretion, they determine you are attempting to
undermine the legitimate operation of the Promotion by cheating, hacking,
deception, or any other unfair playing practices of intending to annoy, abuse,
threaten or harass any other Entrants or Promotion Entities representatives.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE ENTRY PAGES/WEBSITE ASSOCIATED
WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY
BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION
FROM PARTICIPATION IN THE PROMOTION. SHOULD SUCH AN ATTEMPT BE MADE, PROMOTION
ENTITIES AND MLB ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES
(INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL
PROSECUTION.
10. GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS
CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF
THESE OFFICIAL GUIDELINES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR
IN CONNECTION WITH THE PROMOTION SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE
WITH THE INTERNAL LAWS OF THE STATE OF NEW YORK WITHOUT GIVING EFFECT TO ANY
CHOICE OF LAW OR CONFLICT OF LAW GUIDELINES OR PROVISIONS THAT WOULD CAUSE THE
APPLICATION OF ANY OTHER STATE’S LAWS.

PRIVACY POLICY: All information submitted online via the Website by Entrants
is subject to, and will be treated in a
manner consistent with, SportsNet New York's Terms of Use accessible at https://www.sny.tv/about/terms-of-use and Sponsor’s Privacy Policy accessible
at https://www.ny.gov/privacy-policy. By entering the Promotion, you grant Host and
Sponsor permission to share your email address and any other personally
identifiable information with the other Promotion Entities for the purpose of Promotion administration and
prize fulfillment.

Winner List/Official GUIDELINES: To obtain a winners list identifying the recipient
of each prize awarded or to obtain a copy of these Official Guidelines, mail a
self-addressed, stamped envelope to: Creative
