Official Rules

Important: Please read these Official Rules before participating. By participating in this Game, Entrants agree to be bound by these Official Rules and Entrants represent that they satisfy all the eligibility requirements below.

NO PURCHASE OR PAYMENT NECESSARY TO PARTICIPATE OR WIN. MAKING A PURCHASE DOES NOT INCREASE ODDS OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. DESCRIPTION: The Lucky Jump Instant Win Game (“Game”) is an app-based game of chance, as described herein. Game play begins on Tuesday, December 1, 2020 at 4:00 am Central Time (“CT”) and ends on Monday, January 18, 2021 at 4:00 am CT (the “Game Period”). The sponsor of this Game is 7-Eleven, Inc., 3200 Hackberry Road, Irving TX 75063 (“Sponsor”). The promotion administrator is Creative Zing Promotion Group, 2265 Lee Road, Suite 229, Winter Park, Florida 32789 ("Administrator"). The Game developer is Zappar. The Sponsor, Administrator and Game developer shall collectively be referred to as the “Game Entities”. Participation in the Game constitutes Entrant's understanding of and full and unconditional agreement to and acceptance of these Official Rules. Game Entities reserve the right to disqualify any Entrant they determine to be in violation of any term contained in these Official Rules.

2. ELIGIBILITY: The Game is open only to legal U.S. residents physically residing in the fifty (50) United States or the District of Columbia who are at least thirteen (13) years of age at the time of entry who have an active 7Rewards App (as described in Section 3) and who otherwise comply with the Official Rules (“Entrant”). Eligible Entrants who are under the legal age of majority in their state of primary residence (“Minor”) should obtain their parent or legal guardian’s permission to participate. Directors, officers, members, managers, and employees of the Game Entities, and each of their respective parent companies, affiliate companies, subsidiaries, agents, professional advisors, advertising, promotional, public relations, and fulfillment agencies, consultants, legal counsel, website providers, and web masters, together with the Immediate Family Members and/or Household Members of such persons, are not eligible to participate in the Game. For purposes of the Game, "Household Members" shall mean those people who share the same residence at least three months a year, whether or not related; "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses, regardless of where they live.

3. HOW TO PARTICIPATE: There are two (2) ways to participate, as described below. For purposes of these Official Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Game Period beginning at 12:00:01 am CT and ending 11:59:59 pm CT, except for December 1, 2020 when the ‘day’ starts at 4:00 am CT and January 17, 2021 when the ‘day’ will be extended until 4:00 am CT on January 18, 2021. Limit ten (10) Game plays per Entrant per day, regardless of the method of play.

7Rewards App Game Play: The Entrant must own or have family access to an iOS mobile device that runs on iOS10.0 or a later version of iOS or an Android mobile device that runs on Android 5.0 or a later version of Android and have the 7Rewards App (the “App”) on such mobile device and an active 7Rewards account. The App can be obtained for free by visiting Google Play or the iTunes App store and downloading the App to the web-enabled mobile device, then completing an account profile. Data rates may apply. Participation in the 7Rewards program is subject to Sponsor’s Terms, available at https://www.7-eleven.com/terms and Privacy Policy, available in Section 12.

During the Game Period, the Entrant must log into his or her account on the App and click the Game icon in the upper right corner of the home screen to reveal the Game and associated tutorial. Then, Entrant must follow the on-screen instructions to play the Game (each, a “Game Play”) to determine if he or she is a prize winner, subject to compliance with these Official Rules. Potential winners will be notified on-screen. All potential Game winners are subject to verification before a prize will be awarded, at the Sponsor’s discretion. Prizes resulting from Game Play, if applicable, will automatically be added to the Entrant’s 7Rewards App account within approximately 24 hours of winner determination. Entrants may receive one (1) free App Game Play per day for the duration of the Game Period. Entrant may receive up to nine (9) additional Game Plays per day by purchasing any Reese’s Big Cup with Pretzels product (the “Qualified Product”) at a participating 7-Eleven store and scanning the App at checkout to receive one (1) additional Game Play per Qualified Product scan. Additional Game Plays earned through a Qualified Purchase will automatically be added to the Entrant’s App and will be available by clicking the Game icon and engaging in Game Play, as described above. Additional Game Plays earned through the purchase of a Qualified Product must be played on the day earned; any Games Plays that are not played on the day earned will be forfeited at the end of the corresponding day.

All Game Plays must be completed by Monday, January 18, 2021 at 4:00 am CT. Any attempts to obtain additional Game Plays, including through multiple or duplicate accounts, fraud or other illegitimate means may result in disqualification, at the sole discretion of the Game Entities. Standard rewards points may still be accumulated for Qualified Product scans that exceed the Game Play limitations, but no additional Game Plays will be awarded. By participating via the App, Entrant may be charged for standard data use from his or her mobile device according to the terms in the applicable wireless service provider’s data plan. Normal airtime and carrier charges and other charges may apply to data use and will be billed on Entrant’s wireless device bill or deducted from Entrant’s pre-paid balance. Wireless carrier rates vary, Entrant should contact the wireless carrier for specific data plan information.

NO PURCHASE NECESSARY: To participate in the Game without utilizing the App or making a purchase, legibly handwrite on a 3” x 5” your name, email address and 7Rewards App Member ID Number (which can be found by clicking the account icon in the App) and mail the card to: Creative Zing – Lucky Jump Game 4, PO Box 547370, Orlando, FL 32854-7370. Mail-in requests must be postmarked by January 18, 2021 and received by January 22, 2021. Upon receipt, a representative of the Sponsor will play the Game on behalf of the Entrant. Each request will equal up to ten (10) Game Plays. Prizes resulting from Game Play will automatically be added to the Entrant’s 7Rewards App account within approximately 24 hours of winner determination. Following the Entrant’s first Game Play request of the Game Period, the Entrant will be notified that any Prizes resulting from mail-in Game Play for the duration of the Game Period will automatically be added their 7Rewards App. Entrant is responsible for checking his or her App for Prizes. Limit one (1) Game Play request per day. Limit one (1) request per outer stamped mailing envelope. Photocopied or mechanically reproduced Game Play requests are not eligible. Game Entities are not responsible for lost, late, damaged, misdirected, postage-due mailed requests or incorrect/illegible 7Reward Member ID Numbers.

Regardless of method of participation, the Entrant must be the authorized account holder of the registered 7Rewards account. In the event of a dispute over the identity of an Entrant or potential winner, the Entrant or potential winner will be deemed the authorized account holder of the email address associated with the 7Rewards account. “Authorized Account Holder” is defined as the natural person in whose name the e-mail account was opened, if such person is otherwise eligible in accordance with these Official Rules. In the event a dispute regarding the identity of an Entrant or potential winner cannot be resolved to Sponsor’s satisfaction, he or she may be deemed ineligible.

4. INSTANT WIN PRIZE WINNER DETERMINATION: One (1) computer generated winning time will be randomly generated for each instant win prize available. The first Entrant to play the Game at or after one of the randomly generated times, will be the winner of the prize indicated and the prize will automatically be added to winner’s 7Rewards account. Odds of winning an instant win prize depend on the total number of eligible Game Plays received and the time and date upon which Game Play occurs.

The Game Entities shall not be responsible for incorrect or inaccurate information whether caused by Entrant or by any of the equipment or programming associated with or utilized in the Game or by any technical or human error that may occur in the processing of the Gameplay. The Game Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of Game. If due to technical, production or other errors, more prizes are claimed than intended, the intended prizes will be awarded in a random drawing from eligible Entrants. No more than the number of prizes set forth in these Official Rules will be awarded. POTENTIAL WINNING PLAYS MAY BE SUBJECT TO VERIFICATION BY SPONSOR; SPONSOR DECISIONS ARE FINAL AND BINDING. A "SCREEN SHOT" IS NOT PROOF OR EVIDENCE OF A WINNING PLAY AND/OR PRIZE. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE APP SHOULD SO INDICATE, UNLESS AND UNTIL SAID ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED AND THE PRIZE IS AWARDED. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.

Winner must redeem his or her Reese’s Big Cup with Pretzels prize (“Product Prize”) no later than February 18. 2021. To redeem the Product Prize, the winner must: (i) visit a participating 7-Eleven store, (ii) access and select the Product Prize reward in the MyRewards section of the App, and (iii) scan his or her App or enter his or her 7Rewards phone number (if applicable) at checkout. Approximate Retail Value (“ARV”) of one Product Prize is $1.59.

Total ARV of all Product Prizes: $14,998.47.

7Rewards Points are promotional in nature and have no direct cash value. The total ARV of each 7Rewards Points prize is: $0. 7Rewards Points cannot be redeemed for cash and cannot be sold, copied, shared or transferred. Points can be converted into Rewards (“Rewards”) that can be redeemed for select food and beverage items at participating 7-Eleven stores in the United States. The retail value of items obtained using Rewards may vary depending on available promotions and other factors. Rewards must be used in accordance with the 7Rewards terms, available at https://www.7-eleven.com/terms, which are subject to change without notice at any time. Taxes and other charges may apply to redeemed Rewards. Within approximately 24 hours of the prize determination, the 7Rewards Points Prize will be added directly to the winner’s existing point balance in their 7Rewards App.

Prize Restrictions: ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Prizes are not transferable. No substitutions or exchanges of any prize (including for cash) will be permitted, except that Sponsor reserves the right to substitute a prize of comparable or greater worth for any prize. If Sponsor reasonably believes (in its sole discretion) that it will not receive enough Game Plays to award all of the prizes stated in these Official Rules during the Game Period, Sponsor reserves the right to combine lower point prizes (e.g., 1-Point, 5-Point, or 10-Point prizes) and convert them into higher-point prizes, such that the lower-than-expected number of participating Entrants will likely have a better chance of winning higher-point prizes. Otherwise, only the number of prizes stated in these Official Rules are available to be won in the Game.

Except for applicable manufacturer’s standard warranties, the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including any implied warranty of merchantability or fitness for a particular purpose).

6. SECOND CHANCE DRAWING: 7Rewards Point Prizes of One Thousand (1000) 7Rewards Points or greater that are unawarded will be awarded in a Second Chance Drawing (the “Drawing”). If necessary, the Drawing will be conducted by the Administrator on or about January 27, 2021 from amongst all eligible Entrants who participated during the Game Period both through the App and mail-in requests. Any winners will automatically receive their 7Rewards Points Prize directly to their 7Rewards App within approximately 48 hours of the prize determination of the Drawing. Entrants are responsible for checking their 7Rewards App following the Drawing date to see if a second chance prize was awarded. Odds of winning depend upon the number of unclaimed prizes available and the number of eligible Entrants who participated in the Game.

7. DISCLAIMER: Game Entities The Hershey Company and each of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, consultants, contractors, legal counsel, public relations firms, employees and advertising, fulfillment and marketing agencies (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or Gameplays; (b) phone, electronic, hardware, software, network, internet, or other computer or communications-related malfunctions or failures beyond Sponsor or the Released Parties’ reasonable control; (c) any Game disruptions, injuries, losses or damages caused by events beyond the reasonable control of Sponsor or the Released Parties; or (d) any printing, programming or typographical errors in any materials associated with the Game.

8. LIMITATIONS OF LIABILITY AND RELEASES: By participating in the Game, Entrant (or if a Minor, the Entrant’s parent or legal guardian) release Game Entities and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Game or delivery, mis-delivery, acceptance, possession, use of or inability to use any prize (including claims, costs, injuries, losses and damages related to rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

IF ENTRANT IS A MINOR, HIS OR HER PARENTS OR LEGAL GUARDIANS FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY THE ENTRANT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE SPONSOR OR THE RELEASED PARTIES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED TO PARTICIPATION IN THE GAME OR USE OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE GAME OR ANY PRIZE, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO PARTICIPATION IN THE GAME OR USE OF OR INABILITY TO USE ANY EQUIPMENT PROVIDED FOR USE IN THE GAME OR ANY PRIZE EXCEED $10. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT EXCLUDE OR LIMIT LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY PRODUCTS BOUGHT OR RENTED FROM THE SPONSOR, OR FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FOR FRAUD.

9. USE OF WINNER’S NAME AND LIKENESS: To the fullest extent permitted by applicable law, participation into the Game constitutes permission to use Entrant’s name, hometown, aural and visual likeness and prize information for advertising, marketing, and promotional purposes without further permission or compensation (including in a public-facing winner list). As a condition of being awarded any prize, except where prohibited by law, winner may be required to execute a consent to the use of their name, hometown, aural and visual likeness and prize information for advertising, marketing, and promotional purposes without further permission or compensation. By participating in the Game, Entrant (or if a Minor, Entrant’s parent or legal guardian) consents to being contacted by Sponsor for any purpose in connection with this Game.

10. DISPUTES: EACH ENTRANT AGREES THAT ANY DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS GAME OR ANY PRIZE AWARDED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS OR THE APPROPRIATE STATE COURT LOCATED IN DALLAS COUNTY, TEXAS. THESE OFFICIAL RULES ARE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO CHOICE OF LAW OR CONFLICT OF LAW RULES. ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS.

11. GENERAL CONDITIONS: Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its discretion, and to suspend or cancel the Game or any Entrant's participation in the Game should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's reasonable control affect the administration, security or proper play of the Game, or Sponsor otherwise becomes (in its sole discretion) incapable of running the Game as planned. Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Game, tamper with the operation of the Game or engage in any conduct that is detrimental or unfair to Sponsor, the Game or any other Entrant (as determined in Sponsor's sole discretion) are subject to disqualification, in which case, the Entrant’s 7Rewards App privileges may be revoked. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to participate in the Game. Sponsor reserves the right to disqualify any entries received that contain inappropriate or offensive content. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. The use of the terms “include” or “including” in these Official Rules is illustrative and not limiting.

13. WINNER LIST; RULES REQUEST: For a copy of these Official Rules or the list of winners receiving 7Rewards prizes of one thousand points or more, send a stamped, self-addressed, business-size envelope to Creative Zing – Lucky Jump 4 Rules (or Winners), 2265 Lee Road, Suite 229, Winter Park, FL 32789 no later than January 31, 2021. Winner information will be communicated in the form of the 7Reward Member ID Number, with a portion of the number masked for security purposes.
