1. DESCRIPTION: The What Happens Next by T-Mobile promotion (the “Promotion”) will take place beginning
on Friday, October 27, 2023 at 12:01 am Pacific Time
(“PT”) and ending at the the throwing of the
first pitch of the 3rd inning of the final 2023 MLB®
World Series Game (the
“Promotion Period”). During the
Promotion Period, eligible Entrants (as detailed in Section 2 below) will be
invited to participate in a prediction challenge based on the results of each
2023 MLB World Series Game (each a “Game”) (the "Challenge"), and be entered for the chance to receive an individual
prize in a random drawing (the "Sweepstakes"), as detailed
herein. The Sweepstakes will end at the conclusion of the Promotion Period. The
Challenge will consist of a minimum of four (4), and up to a maximum of seven
(7), individual prediction periods, (each a "Prediction Period"),
as detailed in the Prediction Period Chart below.

All dates and times are subject to change, and any
changes will be updated in these Official Rules. Prediction Periods are
directly tied to Game dates and times. Game dates and times are determined in the sole
discretion of the “BOC” (as defined in Section 2 below) and may be
subject to change.
**Sponsor’s device will act as official timekeeper
for tracking first pitch of the 3rd inning for each Game.

The
sponsor of this Promotion is T-Mobile USA, Inc., 12920 SE., 38th Street,
Bellevue, Washington, USA 98006 (“Sponsor”).
The administrator of this Promotion is Creative Zing Promotion Group ("Administrator"),
2100 E. Robinson St., Orlando, FL 32803. The “MLB Entities” (as defined in Section 2
below) are not
responsible for the collection, submission or processing of predictions or entries,
the administration or execution of the Promotion, the determination or
selection of the winners, or any other aspect of this Promotion, except as
explicitly provided herein
2. ELIGIBILITY: This Promotion is open to
legal U.S. residents residing in the fifty (50) United States, Washington, D.C.,
Puerto Rico, and the United States Virgin Islands who are at least eighteen (18)
years of age and the age of majority in their state of primary residence at the
time of entry (each an “Entrant” and collectively, “Entrants”).
Employees,
officers and directors of Sponsor, Administrator and each of their respective
parents, subsidiaries, affiliates, distributors, retailers, sales
representatives, advertising and promotion agencies (the
“Promotion Entities”); the MLB Entities and the Immediate Family
Members, and/or Household Member of each, are ineligible to participate in the Promotion.
For purposes of the Promotion, “Household Member” shall mean any person who shares the same residence at
least three months a year, whether or not related; “Immediate Family Members” shall mean
parents, step-parents, legal guardians, children, step-children, siblings,
step-siblings, or spouses, regardless of where they live. The “MLB Entities”
shall mean the Office of the Commissioner of Baseball (“BOC”), its
Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P.,
Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League
Baseball Clubs (“Clubs”),
each of their parent, subsidiary, affiliated and related entities, any entity
which, now or in the future, controls, is controlled by, or is under common
control with the Clubs or the BOC and the owners, general and limited partners,
shareholders, directors, officers, employees and agents of the foregoing
entities and SeatGeek, Inc. (“SeatGeek”).
In the
event of a dispute over the identity of an Entrant or potential winner in the Promotion,
the Entrant or potential winner will be deemed
the authorized account holder of the phone number used for the
Text Entry or the email address associated with the Email Entry. “Authorized Account
Holder” is defined as the natural
person in whose name the e-mail account associated with the mobile device
service plan or email account used for entry was
opened. In the event a dispute regarding the
identity of an Entrant or potential winner cannot be resolved to Sponsor’s
satisfaction, the affected entry will be deemed ineligible. Entries will not be
acknowledged except as provided herein. Promotion prize is
non-transferable and cannot be substituted, sold or
bartered.
Promotion is void where prohibited.
3. HOW TO ENTER: Eligible Entrants may enter via
two (2) methods of entry:
A. CHALLENGE:
ENTRY METHOD
ONE - TEXT MESSAGE ENTRY VIA A MOBILE DEVICE: During each Prediction Period, an eligible
Entrant may enter by text messaging, from their wireless mobile device as
follows:
a. Text the keyword PREDICT to short code “595959” (the “Short Code”). DO NOT INCLUDE ANY DASH OR SPECIAL CHARACTERS.
b.
Receive
a text reply from Sponsor asking for Entrant to reply with their prediction of
the winner of the corresponding Game and the score for the winning team and the
score for the losing team (the “Prediction”). The Prediction must follow
the following format to be eligible: “Team” name, as provided in the PREDICT text
reply, of the team the Entrant predicts will win the Game, followed by one (1)
space, followed by the numeric score of the Game, with the predicted winning
teams score first, a hyphen, and the predicted losing teams score second (TEAM
X-Y where X equals the winning teams predicted score and Y equals the
losing teams predicted score).
c. Once an Entrant’s text message with their Prediction
is received, they will be sent one (1) follow up text message confirming
receipt of the Entry.
IMPORTANT:
Proof of sending a text message to the Short Code is not considered proof of
delivery to or receipt by Sponsor. You may receive up to ten (10) text messages
in response, including legal disclaimers and options to receive future
promotional text messages from Sponsor. You may opt-out of receiving future
messages at any time by sending the word “STOP” to the Short Code. If an
Entrant sends an opt-out text message, they will be sent a reply text message,
which will confirm that they have been unsubscribed and will receive no further
messages. For help or to see SMS terms, reply “HELP” to the shortcode.
PLEASE NOTE: AGREEING TO RECEIVE FUTURE UPDATES WILL NOT INCREASE
CHANCES OF WINNING.
The text
messaging method of Entry is designed to work with most of the major wireless
service providers in the United States, but Sponsor makes no guarantee that any
particular wireless service provider will participate,
and the mobile phone that is used must be capable of sending and receiving text
messages. Entrants should check their phone’s features to see if they have that
capability. Message and data rates may apply. Wireless service
providers may charge Entrants for each text message, including any error
message that is sent and received in connection with the Promotion, based on
the applicable wireless service pricing plan. Entrants should consult their
wireless service provider’s pricing plan for details. Each text message must be
manually key-stroked/entered by the Entrant. In case of a dispute as to the
identity of a text message Entrant, the Entry will be declared made by the
primary account holder of the account associated with the phone used to enter,
based on the applicable phone company’s records. Each potential winner may be
required to provide proof to Sponsor that they are the primary account holder.
Network service
for transmission of text messages may be interrupted or unavailable due to, but
not limited to, atmospheric or topographical conditions, governmental
regulations, or orders, or system capacity limitations. Sponsor
assumes no responsibility for message delivery or timeliness of messages, or
for the availability of messaging services at all times.
ENTRY METHOD TWO - EMAIL ENTRY: To enter by email, Entrant must send one (1) email
to the following email address: [email protected]. The subject line of the email must say “What Happens With T-Mobile Entry” and
the body of the email must include the Entrant’s Prediction in the following
format to be eligible: TEAM X-Y (where X equals the winning teams
predicted score and Y equals the losing teams predicted score), Entrant’s first
name, last name, and primary phone number, to receive one (1) Entry into the
corresponding Prediction Period.
Limit of one (1) Prediction per Entrant per Prediction
Period, regardless of method of entry. Predictions must be received in
accordance with the Prediction Period Chart above.
B. SWEEPSTAKES: Each Entrant’s first correct
Prediction, during any Prediction Period, will serve as Entrant’s one (1)
Sweepstakes Entry. Limit of one
(1) Sweepstakes Eentry per Entrant total into the
Sweepstakes, for the duration of the Promotion Period.
If any Entrant exceeds the Prediction
limitations, the Entrant may be disqualified, at the Sponsor's sole discretion.
Predictions generated by fraudulent means will
be disqualified. Incomplete, unreadable, or unintelligible Predictions will be
disqualified. Entrants must provide all information requested to be eligible to
win. All
information provided by Entrants becomes the property of Sponsor. Participation in the Promotion constitutes Entrant’s
understanding of and full and unconditional agreement to and acceptance of
these Official Rules. Sponsor reserves the right to disqualify any Entrant that
Sponsor determines to be in violation of any term contained in these Official
Rules. The Promotion Entities shall not
be responsible for incorrect or inaccurate Prdiciton
information caused by any of the equipment or programming associated with or
utilized in the Promotion or by any technical or human error which may occur in
the processing of the Predictions in the Promotion. The Promotion Entities
assume no responsibility or liability for any error, omission, interruption,
deletion, theft or destruction, or unauthorized access to, or alteration of
Entries. Sponsor's
decision not to enforce a specific provision of these Official Rules does not
constitute a waiver of that provision of
the Official Rules generally. Sponsor has the right to change the Promotion Period,
and all other dates or deadlines set in connection with this Promotion, at any
time and in its sole discretion and will post changes on the Website.
4. WINNER SELECTION AND NOTIFICATION:
A.
Challenge: Following
the conclusion of the Game associated with each Prediction Period, in
accordance with the dates and times as detailed in the Prediction Period Chart
above, up to the first five hundred (500) Entrants to make a correct Prediction
(using the correct Prediction format) will be declared Challenge prize winners
(each a “Challenge Winner”) and will receive a “Challenge Prize” (as
detailed in Section 6 below), for the corresponding Game, pending eligibility
verification. Once an Entrant makes a correct Prediction, and receives a
Challenge Prize, they will not be eligible to participate in subsequent
Prediction Periods, if any. In the event there are no correct Predictions, no
Challenge Prizes will be awarded for the applicable Game.
B.
SWEEPSTAKES:
Following the conclusion of the Promotion
Period, one (1) Sweepstakes winner (each a “Sweepstakes Winner”) will be selected via a random drawing, conducted by the
Administrator, from among all eligible Entrants that made a correct Prediction during
the Promotion.
Potential Challenge
Winners and the Sweepstakes Winner (collectively the “Winners”) will be notified at the phone number used for Text
Message Entry, or the email address used for Email Entry. Potential Winners
who entered via Text Message Entry must be able to receive text messages or
calls from a blocked or unknown number. Potential Winners must reply to the
text as instructed or answer the phone and accept the notification call.
Potential Winners that entered via Email Entry will
be notified at the email address used for
Entry. Each potential Winner is responsible
for checking their spam filter. Each potential Winner
will be required to respond to the applicable notification (as directed) within
three (3) days (or a shorter time if required by exigencies) of attempted
notification. The failure to respond within the stated time period may result in forfeiture of the corresponding Prize. Each potential Winner will be required to verify address, sign,
and return within three (3) days of initial notification an affidavit of eligibility, a liability release, and,
unless prohibited by law, a publicity release and other legal documents as may be required by
Sponsor in its sole discretion (collectively,
the "Prize Claim Documents"). The potential Sweepstakes Winner must provide the Administrator with their social
security number for tax reporting purposes before the Sweepstakes Prize will be
awarded. An IRS Form 1099 will be issued to the Sweepstakes Winner for the
actual value of the Sweepstakes Prize received for the year in which the Sweepstakes
Prize was fulfilled. Failure to return the Prize Claim Documents within
the specified time period may result in forfeiture of
the applicable Prize and selection of an alternate winner from the remaining
eligible Entries for the corresponding Prize. Promotion Entities will attempt
to contact up to three (3) potential Winners of a Prize in accordance with the
above procedure, after which the applicable Prize may go unawarded if it
remains unclaimed. Sponsor reserves the right to disqualify anyone not
fully complying with the Official Rules. Winners shall be solely responsible
for any applicable federal, state and/or local taxes, and the reporting
consequences thereof, and for any other fees or costs associated with their Prize. Other restrictions may apply.
5. ODDS: Odds of
winning the Sweepstakes Prize depend on the number of eligible entries received.
6. PRIZES: The
following prizes are available to be won:
A. CHALLENGE PRIZES: There are five hundred (500) Challenge Prizes available for each Game. Each
Challenge Prize consists of two (2) tickets to a 2024 MLB game, awarded in the
form of a SeatGeek.com gift code* for up to $200 in value.
Challenge Prize Provisions: Limit one (1) Challenge Prize per Entrant. The maximum
approximate retail value (“ARV”) of
each Challenge Prize is $200.00. Gift code must be
used in one (1) transaction on SeatGeek.com, and remaining balance following
any transaction will be forefeited by the applicable
Challenge Winner. Each Challenge Winner is responsible for any difference in
the event any gift code transaction exceeds $200. Challenge Prize Winners are solely responsible for any and all
unspecified expenses in conjunction with acceptance and use of the Challenge Prize,
including but not limited to travel to and from the game, lodging, parking, souvenirs
and concessions, if applicable. Challenge Prizes must be accepted as
awarded. Challenge Prizes will be awarded in the name of the Winner and are
not transferrable, assignable or exchangeable for cash. Challenge Prize Winners may not re-sell or
otherwise transfer the Challenge Prize to any other individual or entity. If a Challenge
Prize cannot be awarded due to circumstances beyond the control of the Promotion
Entities a substitute prize of equal or greater retail value may be awarded.
All recipients of a Challenge Prize are required to fully comply with SeatGeek’s terms of use posted at SeatGeek.com/terms and SeatGeek’s privacy policy posted at SeatGeek.com/privacy. Other
restrictions may apply. Limit one (1) Challenge Prize per Entrant. TRANSPORTATION TO/FROM THE GAME AND LODGING
NOT INCLUDED WITH CHALLENGE PRIZE.
Maximum Total ARV
for all Challenge Prizes: $700,000.00.
B. SWEEPSTAKES PRIZE: There is one (1) Sweepstakes Prize available. The Sweepstakes Prize consists of
one (1) 4-day / 3-night trip (“Trip”) for the Sweepstakes Prize Winner and one (1) travel
companion (“Guest”) to attend a 2024 MLB® World Series Game (the “Event”), selected by Sponsor in
its sole discretion. Travel will
take place in conjunction with the 2024 MLB®
World Series,
and travel dates will be communicated to the Sweepstakes Prize Winner upon
confirmation of the 2024 MLB® World Series schedule. The Trip will consist of the following: (a.)
round-trip economy class air transportation for the Sweepstakes Prize Winner
and their Guest from a major airport near the Sweepstakes Prize Winner’s home
(as determined by Sponsor) to the host city; (b.) hotel accommodations for
three (3) nights at a host city area hotel chosen by Sponsor (one (1) room,
double occupancy, room and tax only); and (c.) two
(2) tickets for the Sweepstakes Prize Winner for the Event. ARV of each Sweepstakes
Prize: Three Thousand Dollars ($3,000).
Maximum
Total ARV of Sweepstakes Prizes: $3,000.00
Sweepstakes Prize Winner
is solely responsible for any and all unspecified
expenses in conjunction with acceptance and use of the Sweepstakes Prize,
including but not limited to parking, meals, souvenirs, concessions, ground
transportation, and any other expenses not specifically mentioned
as being included. Sweepstakes Prize must be accepted as awarded. Use of any Major League Baseball
game/event/exhibition ticket is subject to the standard terms, conditions, and
health and safety policies applicable to the ticket; see mlb.com/ticketback for details. Seat locations at any game/event/exhibition
and, unless otherwise stated in the prize description, exact game/event/ exhibition
date shall be determined in the sole discretion of Sponsor. Sweepstakes Prize Winner’s
Guest must be of legal age of majority in their jurisdiction of residence
unless accompanied by a parent or legal guardian. Sweepstakes Prize does not include tickets to or for any other game, event or exhibition during the 2024 season other than as
specifically set forth herein. Major League Baseball game, event and exhibition
dates and times are determined in the sole discretion of the BOC and/or the
applicable Club, and may be subject to change. The
terms and conditions of the tickets awarded as part of any prize will govern in
the event a legal game, event or exhibition, as
defined by Major League Baseball, is not played or held, as applicable, due to
weather conditions, an act of God, an act of terrorism, civil disturbance or
any other reason. Sweepstakes Prize Winner and their guest agree to comply with
all applicable ballpark and venue, as applicable, regulations in connection
with a Sweepstakes Prize. Sponsor and the applicable MLB Entities reserve the
right to remove or to deny entry to any winner and/or their guest who engage(s)
in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse,
threaten or harass any other person at the game, event
or exhibition. Sponsor and the MLB Entities will not be responsible for weather
conditions, Acts of God, acts of terrorism, civil disturbances, local, state or federal regulation, order or policy, work stoppage,
epidemic, pandemic, or any other issue concerning public health or safety, or
any other event outside their control that may cause the cancellation or
postponement of any Major League Baseball game, event or exhibition. Major
League Baseball game, event and exhibition tickets awarded as prizes may not be
resold or offered for resale or used for any commercial or promotional purpose
whatsoever. Any such resale or commercial or promotional use may result in
disqualification and Sweepstakes Prize forfeiture, and may invalidate the
license granted by the game, event or exhibition
tickets. Sponsor and the MLB Entities (a) make no warranty, guaranty or
representation of any kind concerning any prize (or any portion thereof), and
(b) disclaim any implied warranty.
SWEEPSTAKES PRIZE WINNER MUST BE AVAILABLE TO
TRAVEL DURING THE 2024 MLB® WORLD SERIES DATES OR WILL BE INELIGIBLE TO RECEIVE
THE SWEEPSTAKES PRIZE. The dates of
departure and return are subject to change at Sponsor’s sole discretion. All Sweepstakes Prize details
are at the sole discretion of the Sponsor. If the Sweepstakes
Prize Winner is unable to participate in the Trip during the dates chosen by
Sponsor, the Sweepstakes Prize will be forfeited in its entirety and, time
permitting, an alternate Sweepstakes Prize Winner will be selected. If any of
the events, or any portion thereof, listed in the Sweepstakes Prize description
does not or cannot take place as scheduled or at all, for reasons included but
not limited to scheduling conflicts, cancellations, postponement, or for any
other reason, then assuming the Sweepstakes Prize Winner is willing and able to
travel on the dates chosen by Sponsor, the Sweepstakes Prize Winner will
receive the remaining components of the Sweepstakes Prize which shall
constitute full satisfaction of Sponsor’s Sweepstakes Prize obligation to the Sweepstakes
Prize Winner, and no other or additional compensation will be awarded. Actual
value of Sweepstakes Prize will depend on point of departure, any airfare
fluctuations and seasonal pricing; any difference will not be awarded.
Selection of Trip dates is at the sole discretion of Sponsor and Event
schedule. In the event the Sweepstakes Prize Winner lives within one hundred
(100) miles of the host city, air travel will not be included in the Trip and
the Sweepstakes Prize Winner will be compensated a total of two hundred dollars
($200) in lieu of air travel, for any alternate travel expenses. Sponsor
reserves the right, in its sole discretion, to provide a projected tax gross-up
allowance to help offset income tax liability. If applicable, a projected
tax gross-up allowance will be awarded in the form of a check in an amount
determined by Sponsor prior to December 31, 2024. If income taxes exceed such
amount, the additional expenses shall be the responsibility of the Sweepstakes
Prize Winner, as applicable.
The Sweepstakes Prize Winner’s Guest must be at least eighteen (18) years of age and the age
of majority in their state of primary residence unless
the Sweepstakes Winner is such minor Guest’s parent or legal guardian. If Sweepstakes Prize Winner is between the ages of eighteen (18) and
twenty-one (21), they may need to be accompanied by an adult of at least
twenty-one (21) years of age in order to check into
the on-site hotel. Sweepstakes Prize Winner and their Guest must
travel together on same itinerary for the Trip and are responsible for
obtaining all necessary travel documents. Sweepstakes Prize Winner and Guest
agree to undertake the Trip at their own risk. All travel arrangements must be
made through Sponsor’s agent. Airline for Trip will be selected by Sponsor in
their sole discretion. Airline carrier’s regulations and conditions apply.
Other travel restrictions and blackout dates may apply. All airline tickets are
subject to the vagaries of flight variation, work stoppages, and schedule or
route changes. Once Trip dates have been booked, no changes, extensions or
substitutions are permitted, except at Sponsor’s sole discretion. Sponsor will
not replace any lost or stolen tickets or travel vouchers. Sponsor reserves the
right to structure travel routes and select hotels in its sole discretion. Any costs of travel exceeding the
allowance provided herein shall be the sole responsibility of the Sweepstakes
Prize Winner. For the
avoidance of doubt, the Sweepstakes
Prize Winner shall be
solely responsible for all costs, expenses, and
incidentals associated with Sweepstakes Prize acceptance and use, including,
but not limited to, ground transportation, meals, beverages, gratuities, phone
calls, insurance, taxes, and any other expenses not specifically mentioned as
being included. Once travel commences, no unscheduled stopovers are permitted; if an
unscheduled stopover occurs, full airfare may be charged to the Sweepstakes
Prize Winner from stopover point for the remaining segments, including return,
of the Trip. Promotion Entities and MLB Entities are not liable for any
expenses incurred as a consequence of flight
cancellation/delay. Trip may not be combined with any other offer and travel
may not qualify for frequent flyer miles. Promotion Entities and MLB Entities will not obtain
travel insurance on behalf of the Sweepstakes Prize Winner or Guest. Travel is subject to
flight availability and other travel restrictions may apply. Sweepstakes
Prize Winner is
responsible for all applicable travel and other insurance, all applicable
airport charges, including, without limitation, any baggage charges, airport
taxes, fuel charges and any applicable Customs or Federal inspection fees.
Sponsor reserves the right to change travel dates and to substitute any or all of these portions of the Sweepstakes Prize for a prize
of comparable or greater value should they become unavailable or impractical
for any reason. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND
EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE SWEEPSTAKES PRIZE ARE THE
SOLE RESPONSIBILITY OF THE SWEEPSTAKES PRIZE WINNER. The
ARV for travel prizes is an estimate made before the Promotion begins. If
the actual value of any prize is less than the ARV stated herein, the Sweepstakes
Prize Winner will NOT be entitled to a check, cash or
other form of payment for the price difference. The round-trip air
transportation element for any travel prize begins and ends at the point of
departure. Other hotel fees are not included and if applicable may be payable
at the time of check-out by the Sweepstakes Prize Winner/Guest. A deposit or
payment in advance, or presentation of a credit card by the Sweepstakes Prize Winner,
may be required at the time of check-in at the hotel. Any hotel cancellations
or changes to hotel reservations after confirmation must be made with the hotel
directly, and the Sweepstakes Prize Winner is solely responsible for any
charges and/or fees arising from changes made directly with the hotel. Sweepstakes
Prize Winner cannot
assign or transfer the Sweepstakes Prize to another person, except at
discretion of Sponsor. If the Sweepstakes Prize cannot be awarded due to
circumstances beyond the control of Sponsor, a substitute prize of equal or
greater retail value will be awarded. If Sweepstakes
Prize is awarded but unclaimed/forfeited by recipient, Sweepstakes Prize may
not be re-awarded, in Promotion Entities' sole discretion. Other restrictions may apply. The
Sweepstakes Prize, and all portions of the Sweepstakes Prize, are awarded
WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. No prize
substitution or cash alternative is allowed except at the sole discretion of
Sponsor. Any Sweepstakes Prize depictions are
for illustrative purposes only.
Trip Conduct: Sweepstakes Prize Winner
and Guest shall conduct themselves with due regard to the public conventions
and morals. The Sweepstakes Prize Winner and Guest shall not, while
representing the Promotion Entities and MLB Entities during the Trip and/or any of the events, or any portion thereof, listed in the Sweepstakes
Prize description, commit
an offense involving moral turpitude under local laws or ordinances. The Sweepstakes
Prize Winner and Guest shall not commit any act that will tend to degrade the Promotion
Entities and/or MLB Entities in society or bring the Promotion Entities and/or
MLB Entities into public hatred, public disrepute, contempt, scorn, or
ridicule, or that will tend to shock, insult or offend
the community or public morals or decency or prejudice the Promotion Entities
and/or MLB Entities. In the event the Sweepstakes Prize Winner or Guest
engages in behavior that (as determined by Promotion Entities and/or MLB
Entities in their sole discretion) is obnoxious or threatening, illegal or that
is intended to annoy, abuse, threaten or harass any other person, the Promotion
Entities and/or MLB Entities reserve the right to expel the Sweepstakes Prize Winner
and Guest from any of the events, or any portion thereof, listed
in the Sweepstakes Prize description, terminate the Trip early and send the Sweepstakes
Prize Winner and Guest home with no further obligation related to the Sweepstakes
Prize.

In connection with
any Trip and/or Event, please be advised that Event
policies, CDC guidelines, and the recommendations of health officials must be
followed. In addition, the Sweepstakes Prize Winner and Guest, if applicable,
should be aware of and comply with government guidelines regarding travel
restrictions and mandatory quarantines before visiting any destination. Please note that any public location where people
are present provides an inherent risk of exposure to COVID-19, and Sponsor
cannot guarantee that any person will not be exposed during the Trip. By accepting a Prize, the Sweepstakes Prize Winner, on behalf
of themself and on behalf of any individuals who use the Trip or attend any
Event as a Guest, expressly assumes the risk that during use of the Trip and/or
Event attendance they may be exposed to COVID-19, the Coronavirus that causes
COVID-19, or other communicable and/or infectious diseases. Sweepstakes Prize
Winner and Guest,
if any, expressly understand that these risks include contracting COVID-19 or
other communicable and/or infectious diseases and the associated dangers,
medical complications and physical and mental
injuries, both foreseen and unforeseen, that may result from contracting
COVID-19 or other communicable and/or infectious diseases.
7. CONDITIONS OF PARTICIPATION/RELEASES: All federal, state
and local laws and regulations apply. By participating, each Entrant agrees to
be bound by these Official Rules and the decisions of the Promotion Entities,
which shall be final in all respects. By participating in this Promotion and/or
by accepting any Prize, each Entrant agrees to release the Promotion
Entities, MLB Entities, and each of their respective successors, employees,
officers, directors, agents, representatives and assigns (collectively, the
"Released Parties") from
any and all actions, claims, injury, loss or damage arising in any manner,
directly or indirectly, from participation in this Promotion and/or acceptance
or use of any Prize. Each Entrant authorizes the Sponsor, the MLB Entities and their designees to use their name, voice,
likeness, biographical data, city and state/territory of residence and Entry
materials in programming or promotional material, worldwide in perpetuity, and
on a winner's list, if applicable, without further notice or compensation
unless prohibited by law. Sponsor and MLB Entities are not obligated to use any
of the above-mentioned information or materials, but
may do so and may edit such information or materials, at their sole discretion,
without further obligation or compensation. The Released Parties shall not be
liable for: (i) any injuries, losses, liabilities or damages of any kind caused
by the any Prize or resulting from acceptance, possession or use of the corresponding
Prize, or from participation in the Promotion; (ii) telephone system, telephone
or computer hardware, software or other technical or computer malfunctions,
lost connections, disconnections, delays or transmission errors; (iii) data
corruption, theft, destruction, unauthorized access to or alteration of Prediction
or other materials; (iv) late, lost, delayed, stolen, incomplete, unreadable,
inaccurate, garbled or unintelligible Predictions, regardless of the method of
transmission; (v) any inability of winner
to accept or use any Prize (or portion thereof) for any reason and such Prize
or portion thereof shall be forfeited; or (vi) any printing, typographical,
human administrative or technological errors in any materials associated with
the Promotion. Promotion Entities reserve the right, in their sole discretion,
to cancel, modify or suspend the Promotion (or any portion of the Promotion)
should a virus, bug, computer problem, unauthorized intervention, extenuating
circumstance or other problem/cause corrupt or inhibit the administration,
security or proper play of the Promotion and, in such situation, will select winners
from eligible non-suspect Predictions received prior to and/or after such
action or in such manner as deemed fair and appropriate by the Promotion
Entities. Promotion Entities may prohibit Entrant from participating in the Promotion
or winning a prize if, in its sole discretion, it determines Entrant is
attempting to undermine the legitimate operation of the Promotion by cheating,
hacking, deception, or any other unfair practices or intending to annoy, abuse,
threaten or harass any other Entrants, Promotion Entities or MLB Entities
representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE
OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND
WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROMOTION. SHOULD

CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE

9. ARBITRATION
PROVISION: By participating in this Promotion, each
Entrant agrees that any and all disputes the Entrant may have with, or claims
Entrant may have against, the Released Parties relating to, arising out of or
connected in any way with (i) the Promotion, (ii) the awarding or redemption of
any prize, and/or (iii) the determination of the scope or applicability of this
agreement to arbitrate, will be resolved individually and exclusively by final
and binding arbitration administered by the National Arbitration Forum (the “Forum”)
and conducted before a sole arbitrator pursuant to the Code of Procedure
established by the Forum. The arbitration shall be held at a location
determined by the Forum pursuant to the Code of Procedure, or at such other
location as may be mutually agreed upon by the Entrant and Sponsor. The
arbitrator’s decision shall be controlled by the terms and conditions of these
Official Rules and any of the other agreements referenced herein that the
applicable Entrant may have entered into in connection
with the Promotion. There shall be no
authority for any claims to be arbitrated on a class or representative basis;
arbitration can decide only the Entrant’s and/or Sponsor’s individual claims
and the arbitrator may not consolidate or join the claims of other persons or
parties who may be similarly situated.
The arbitrator shall not have the power to award special or punitive
damages against the Entrant or Released Parties. For more information on the Forum and/or the

Arbitration Provision is deemed to be invalid or otherwise unenforceable or
illegal, the balance of this Arbitration Provision shall remain in effect and
shall be construed in accordance with its terms as if the invalid or illegal
provision were not contained herein.
10. PRIVACY POLICY: Any
personal information supplied by you to Sponsor will be subject to Sponsor's
privacy policy posted at https://www.t-mobile.com/responsibility/privacy/privacy-policy. By participating in the Promotion, you grant Sponsor permission to share
your mobile telephone number, email address and any other personally
identifiable information with the other Promotion Entities and the MLB Entities
for the purpose of Promotion administration and Prize fulfillment. Sponsor will
not sell, rent, transfer or otherwise disclose your personal data to any third
party other than as explicitly described herein or in accordance with Sponsor’s
privacy policy.

4. DESCRIPCIÓN: La promoción What Happens
Next by T-Mobile (la “Promoción”) tendrá lugar
a partir del viernes 27 de octubre de 2023 a las 12:01 a. m., hora del Pacífico
(“PT”), y finalizará con el primer lanzamiento de la 3.a entrada
de la final del Partido de la Serie Mundial MLB® de 2023 (el “Período
de la Promoción”). Durante el Período de la Promoción, se invitará a los
Participantes elegibles (según se detalla en la Sección 2 más abajo) a
participar en un desafío de pronóstico basado en los resultados de cada Partido
de la Serie Mundial de MLB de 2023 (individualmente, “Partido”) (el “Desafío”),
ya que se inscribirán para tener la oportunidad de recibir un premio individual
en un sorteo aleatorio (el “Sorteo”), como se especifica en este
documento. El Sorteo finalizará al concluir el Período de la Promoción. El

uno no son elegibles para participar en la Promoción. Para fines de la

Promoción, el Participante o posible ganador se
considerará el titular autorizado del número de teléfono que se

dirección de correo electrónico asociada con la Participación vía correo
electrónico. “Titular Autorizado de la Cuenta” se define como la
persona física en cuyo nombre se abrió la
cuenta de correo electrónico asociada con el plan de servicio del dispositivo
móvil o la cuenta de correo electrónico utilizada para la participación. En caso de que una disputa sobre la identidad de un
Participante o potencial ganador no se pueda resolver a satisfacción del
Patrocinador, la participación afectada se considerará no elegible. Las
participaciones se reconocerán únicamente como se indica en el presente
documento. El premio de la Promoción es intransferible y no se puede sustituir,
vender o intercambiar. La Promoción no es válida donde esté prohibida.
6. CÓMO PARTICIPAR: Los
Participantes elegibles pueden hacerlo a través de dos (2) métodos de
participación:

MÉTODO DE PARTICIPACIÓN
UNO; PARTICIPACIÓN POR MENSAJE DE TEXTO A TRAVÉS DE UN DISPOSITIVO MÓVIL: Durante el Periodo de Pronóstico, un Participante
elegible podrá participar, mediante mensajes de texto, desde su dispositivo
móvil inalámbrico de la siguiente manera:
a. Envía un mensaje
de texto con la palabra clave PREDICT (pronóstico) al código corto “595959”
(el “Código Corto”). NO INCLUYA NINGÚN GUIÓN O CARÁCTER ESPECIAL.
b.
Recibe una
respuesta de texto del Patrocinador en la que le solicita al Participante que
responda con su pronóstico del ganador del Partido correspondiente y la
puntuación del equipo ganador y la puntuación del equipo perdedor (el “Pronóstico”).
El Pronóstico debe seguir el formato a continuación para ser elegible: El
nombre del “Equipo”, tal y como aparece en la respuesta del texto PREDICT, que
el Participante pronostica que ganará el Partido, seguido de un (1) espacio, y
luego la puntuación numérica del Partido, primero la puntuación pronosticada
del equipo ganador, un guión, y después la puntuación
pronosticada del equipo perdedor (EQUIPO X-Y, donde X es igual a la
puntuación pronosticada del equipo ganador e Y es igual a la puntuación
pronosticada del equipo perdedor).
c. Una vez que se
reciba el mensaje de texto de un Participante con su Pronóstico, se le enviará
un (1) mensaje de texto de seguimiento que confirme la recepción de la
Participación.
IMPORTANTE: La
evidencia del envío de un mensaje de texto al Código Corto no se considera una
evidencia de entrega o recepción por parte del Patrocinador. Puede recibir
hasta diez (10) mensajes de texto en respuesta, que incluyen avisos legales y
opciones para recibir futuros mensajes de texto promocionales del Patrocinador.
Puede darse de baja de futuros mensajes en cualquier momento enviando la
palabra “STOP" (alto) al Código Corto. Si un Participante envía un mensaje
de texto para darse de baja, se le enviará un mensaje de texto de respuesta,
que confirmará que se ha dado de baja y que no recibirá más mensajes. Para
obtener ayuda o consultar las condiciones de los SMS, responda “HELP” (ayuda)
al código corto. TENGA EN CUENTA LO SIGUIENTE: ACEPTAR RECIBIR
ACTUALIZACIONES FUTURAS NO AUMENTARÁ LAS POSIBILIDADES DE GANAR.
El método de
Participación por mensaje de texto está diseñado para que funcione con la
mayoría de los proveedores de servicio inalámbrico en los Estados Unidos, pero
el Patrocinador no garantiza la participación de ningún proveedor de servicio
inalámbrico determinado ni que el teléfono móvil utilizado sea capaz de enviar
y recibir mensajes de texto. Los Participantes deben verificar las funciones de
su teléfono para ver si tiene esta capacidad. Pueden aplicarse tarifas por
datos y mensajes. Los proveedores de servicios inalámbricos pueden cobrarle
a los Participantes cada mensaje de texto, incluidos los mensajes de error que
se envíen y se reciban en relación con la Promoción, según el plan de precios
de servicios inalámbricos correspondiente. Para más detalles, los Participantes
deben consultar los precios de su plan con su proveedor de servicio
inalámbrico. El Participante debe ingresar manualmente cada mensaje de texto.
En caso de disputa sobre la identidad de un Participante por mensaje de texto,
se declarará que la Participación fue realizada por el titular principal de la

solicitar que le proporcione una prueba al Patrocinador de que es el titular
principal de la cuenta.
El servicio de la
red para la transmisión de mensajes de texto puede verse interrumpido o no
estar disponible debido a, entre otras, condiciones atmosféricas o
topográficas, reglamentos u órdenes gubernamentales o limitaciones en la
capacidad del sistema. El Patrocinador no se hace responsable de la entrega ni
la puntualidad de los mensajes, ni por la disponibilidad de los servicios de
mensajería en ningún momento.
MÉTODO DE
PARTICIPACIÓN DOS; PARTICIPACIÓN POR CORREO ELECTRÓNICO: Para participar
por correo electrónico, el Participante debe enviar un (1) correo electrónico a
la siguiente dirección: [email protected]. Como asunto del correo electrónico debe decir “What Happens With
T-Mobile Entry” (Participación en What
Happens With T-Mobile) y el
cuerpo del correo electrónico debe incluir el Pronóstico del Participante en el
siguiente formato para ser elegible: EQUIPO X-Y (donde X es igual a la
puntuación pronosticada del equipo ganador e Y es igual a la puntuación
pronosticada del equipo perdedor), el nombre, apellido y número de teléfono
principal del Participante para recibir una (1) Participación en el Período de Pronóstico
correspondiente.
Límite de un (1)
Pronóstico por Participante por Período de Desafío, independientemente del
método de participación. Los Pronósticos deben recibirse de acuerdo con la
Tabla de períodos de pronóstico anterior.
D. SORTEO: El primer
Pronóstico general de cada Participante, durante cualquier Período de
Predicciones, servirá como una (1) Participación en el Sorteo del Participante.
Límite de una (1) participación en el Sorteo por Participante en total en el
Sorteo, durante la duración del Período de la Promoción.
Si algún Participante excede los límites de
Pronósticos, puede ser descalificado a la entera discreción del Patrocinador.
Los Pronósticos generados por medios fraudulentos serán descalificados. Los
Pronósticos incompletos, ilegibles o ininteligibles serán descalificados. Los
Participantes deberán proporcionar toda la información solicitada para ser
elegibles para ganar. Toda la información proporcionada por los Participantes
será propiedad del Patrocinador. La participación en la Promoción constituye
la comprensión, la aceptación y el acuerdo pleno e incondicional de estas
Reglas oficiales por parte del Participante. El Patrocinador se reserva el
derecho a descalificar a todo Participante que, según el Patrocinador, incumpla
cualquier término presente en estas Reglas oficiales. Las Entidades de la
Promoción no serán responsables de la información incorrecta o inexacta de los
Pronósticos que sea originada por alguno de los equipos o programas asociados
con o utilizados en la Promoción o por algún error técnico o humano que pueda
ocurrir en el procesamiento de los Pronósticos durante la Promoción. Las
Entidades de la Promoción no asumen ninguna responsabilidad u obligación por
ningún error, omisión, interrupción, eliminación, robo o destrucción, o acceso
no autorizado a o alteración de las Participaciones. La decisión del
Patrocinador de no aplicar una disposición específica de estas Reglas oficiales
no se considerará una exención de esa disposición de las Reglas oficiales en general.
El Patrocinador tiene derecho a cambiar el Período de la Promoción y todas
las demás fechas o plazos establecidos en relación con esta Promoción, en
cualquier momento y a su entera discreción, y publicará los cambios en el Sitio
web.
5. SELECCIÓN Y NOTIFICACIÓN DEL GANADOR:

Desafío: Tras la conclusión del Partido asociado con cada
Período de Pronóstico, de acuerdo con las fechas y horas detalladas en la Tabla
de Períodos de Pronóstico anterior, hasta los primeros quinientos (500)
Participantes que realicen un Pronóstico correcto (utilizando el formato de
Pronóstico correcto) serán declarados ganadores del premio del Desafío
(individualmente, “Ganador del Desafío”) y recibirán un “Premio del
Desafío” (tal y como se detalla en la Sección 6 más abajo), para el Partido
correspondiente, pendiente de verificación de elegibilidad. Una vez que un
Participante haga un Pronóstico correcto y reciba un Premio del Desafío, éste
no será elegible para participar en los Períodos de Pronóstico posteriores, si
los hubiera. En caso de que no haya Pronósticos correctos, no se otorgarán
Premios del Desafío para el Partido correspondiente.

SORTEO:
Tras la
conclusión del Período de la Promoción, se seleccionará un (1) ganador de
Sorteo (individualmente, “Ganador del Sorteo”) a través de un sorteo aleatorio, realizado por el Administrador, de
entre todos los Participantes elegibles que hicieron un Pronóstico correcto
durante la Promoción.
Los Ganadores Potenciales
del Desafío y el Ganador del Sorteo (en conjunto, los “Ganadores”) recibirán una notificación en el número de
teléfono utilizado para la Participación por Mensaje de Texto, o en la
dirección de correo electrónico utilizada para la Participación por Correo
Electrónico. Los Ganadores potenciales que hayan participado por Mensaje de
Texto deben poder recibir mensajes de texto o llamadas de un número bloqueado o
desconocido. Los Ganadores potenciales deben responder al mensaje de texto
según las instrucciones o contestar el teléfono y aceptar la llamada de
notificación. Los Ganadores potenciales que hayan participado por Correo
Electrónico recibirán una notificación en
la dirección de correo electrónico utilizada para la Participación. Cada
Ganador potencial es responsable de revisar su filtro de correo no deseado.
Cada Ganador potencial deberá responder a la notificación correspondiente (como
se indica) en un plazo de tres (3) días (o un periodo menor si lo indican los
requisitos) del intento de notificación. No responder en el plazo indicado puede resultar en la renuncia
del Premio correspondiente. Cada Ganador
potencial deberá verificar su dirección, firmar y presentar en un periodo de
cinco (3) días posteriores a la notificación inicial una declaración
jurada de elegibilidad, una exención de responsabilidad, y, a menos que la ley
lo prohíba, una autorización para uso publicitario y otros documentos legales
que pueda requerir el Patrocinador a su criterio exclusivo (colectivamente, los
“Documentos de Reclamación del Premio”). El Ganador potencial del Sorteo
debe proporcionar al Administrador su número de seguro social para fines de
declaración de impuestos antes de que se otorgue el Premio del Sorteo. Se
emitirá un Formulario 1099 del IRS al Ganador del Sorteo por el valor real del
Premio del Sorteo recibido para el año en que éste fue entregado. El
incumplimiento en la presentación de los Documentos de Reclamación del Premio
dentro del período especificado puede resultar en la pérdida del premio
correspondiente y en la selección de un ganador alternativo de entre las
Participaciones elegibles restantes para el premio correspondiente. Las
Entidades de la Promoción intentarán contactar hasta a tres (3) Ganadores
potenciales de un Premio de acuerdo con el procedimiento anterior, después de
lo cual el Premio correspondiente podría no ser entregado si nadie lo
reclamara. El Patrocinador se reserva el derecho de descalificar a cualquiera
que no cumpla en su totalidad con las Reglas Oficiales. Los Ganadores serán los
únicos responsables de todo impuesto federal, estatal y/o local aplicable, así
como de reportar el mismo, y de cualquier otro honorario o costo relacionado
con el Premio. Es posible que apliquen otras restricciones.
13.
PROBABILIDADES: Las probabilidades de ganar el Premio del Sorteo
dependen de la cantidad de participaciones elegibles recibidas.

PREMIOS: Se pueden ganar los siguientes premios:
C. PREMIOS DEL
DESAFÍO: Hay quinientos (500) Premios del Desafío disponibles
para cada Partido. Cada Premio del Desafío consiste en dos (2) boletos para un
partido de MLB de 2024 que se otorgan en forma de código de regalo*
SeatGeek.com por un valor de hasta $200.
Disposiciones del Premio del Desafío: Límite de un (1) Premio del Desafío por Participante.
El valor comercial máximo aproximado (“ARV”) de cada Premio del Desafío
es de $200.00. El código de regalo debe utilizarse en una (1) transacción en
SeatGeek.com, y el Ganador del Desafío correspondiente perderá el saldo
restante después de cualquier transacción. Cada Ganador del Desafío es responsable
de cualquier diferencia en caso de que alguna transacción del código de regalo
exceda los $200. Los Ganadores del Premio del
Desafío son los únicos responsables de todos y cada uno de los gastos no
especificados en relación con la aceptación y el uso del Premio del Desafío,
incluidos, entre otros, los viajes de ida y vuelta al Partido, el alojamiento,
el estacionamiento, los recuerdos y las concesiones, si corresponde. Los
Premios del Desafío deben aceptarse tal como son otorgados. Los Premios
del Desafío se otorgarán a nombre del Ganador y no son transferibles,
asignables ni canjeables por dinero en efectivo. Los Ganadores del Premio del
Desafío no podrán revender ni transferir el Premio del Desafío a ninguna otra
persona o entidad. Si un Premio del Desafío no se puede otorgar debido a
circunstancias fuera del control de las Entidades de la Promoción, se podrá
otorgar un premio sustituto de valor comercial igual o mayor. Todos los ganadores de un Premio del Desafío
están obligados a cumplir plenamente con los términos de uso de SeatGeek publicados en SeatGeek.com/terms
y la política de privacidad de SeatGeek publicada en

D. PREMIO DEL
SORTEO: Hay un (1) premio del sorteo disponible. El Premio del
Sorteo consiste en un (1) viaje de 4 días/3 noches (el “Viaje”) para el
Ganador del Premio del Sorteo y un (1) acompañante de viaje (el “Invitado”)
para asistir a un Partido de la Serie Mundial de MLB® de 2024 (el “Evento”),
seleccionado por el Patrocinador a su entera discreción. El viaje se
llevará a cabo junto con la Serie Mundial de MLB® de 2024, y las
fechas de viaje se comunicarán a cada Ganador del Premio del Sorteo una vez que
se confirme el calendario de la Serie Mundial de MLB® de 2024. El
Viaje consistirá en lo siguiente: (a) transporte aéreo de ida y vuelta en clase
económica para el Ganador del Premio del Sorteo y su Invitado desde un
aeropuerto importante cerca de la casa del Ganador del Premio del Sorteo (según
lo determine el Patrocinador) a la ciudad anfitriona; (b) alojamiento en hotel
por tres (3) noches en un hotel del área de la ciudad anfitriona elegido por el
Patrocinador (una [1] habitación doble, habitación e impuestos solamente); y
(c) dos (2) boletos para el Ganador del Premio del Sorteo para el Evento. ARV
de cada Premio del Sorteo: Tres mil dólares ($3,000).
ARV máximo de los Premios del Sorteo:
$3,000.00.
El Ganador del Premio del Sorteo es el único responsable de todos y cada
uno de los gastos no especificados en relación con la aceptación y el uso del
Premio del Sorteo, incluidos, entre otros, el alojamiento, las comidas, los
recuerdos, las concesiones, el transporte terrestre y cualquier otro gasto no
mencionado específicamente como incluido. El Premio del Sorteo debe aceptarse
tal como es otorgado. El uso de cualquier boleto para un
partido/evento/exhibición de Major League Baseball está sujeto a los términos, condiciones y políticas
de salud y seguridad estándar aplicables al boleto; consulte mlb.com/ticketback para obtener más detalles. Los asientos
en cualquier partido/evento/exhibición y, a menos que se indique lo contrario

determinarán a criterio exclusivo del Patrocinador. El Invitado del Ganador del
Premio del Sorteo debe ser mayor de edad en su jurisdicción de residencia, a
menos que esté acompañado por un padre o tutor legal. El Premio del
Sorteo no incluye boletos para ningún partido, evento o exhibición durante la
temporada 2024 que no esté especificado en el presente. Las fechas y los
horarios de los partidos, los eventos y las exhibiciones de Major
League Baseball se determinarán a criterio exclusivo
de la BOC y/o el Club aplicable, y pueden estar sujetas a cambios. Los términos
y condiciones de los boletos otorgados como parte de un premio regirán en caso
de que no se lleve a cabo un partido, evento o exhibición legal, según lo
define Major League Baseball,
según corresponda, debido a condiciones ambientales, una causa de fuerza mayor,
un acto de terrorismo, un disturbio social o cualquier otro motivo. El Ganador
del Premio del Sorteo y su invitado aceptan cumplir con todas las disposiciones
aplicables del estadio de béisbol y el lugar de reunión, según corresponda,
relacionadas con un Premio del Sorteo. El Patrocinador y las Entidades de MLB
aplicables se reservan el derecho de retirar o negar la entrada a cualquier Ganador
y/o su Invitado que se comporte(n) de forma antideportiva o inadmisible o con
la intención de molestar, maltratar, amenazar u hostigar a cualquier persona en
el partido, evento o exhibición. El Patrocinador y las Entidades de MLB no
serán responsables de las condiciones climáticas, causas de fuerza mayor, actos
de terrorismo, disturbios sociales, disposiciones locales, estatales o
federales, orden o política, suspensiones laborales, epidemias, pandemias o
cualquier otra cuestión relativa a la salud o seguridad pública, o cualquier
otro evento natural fuera de su control que pudiera causar la cancelación o
postergación de cualquier partido, evento o exhibición de Major
League Baseball. Los boletos para un partido, un evento o una exhibición de Major League Baseball otorgados
como premios no se pueden revender ni ofrecer para reventa ni usar con ningún
fin comercial o promocional. Toda reventa o uso comercial o promocional puede
resultar en la descalificación y la pérdida del Premio del Sorteo, y puede invalidar
la licencia otorgada por los boletos del partido, evento o exhibición. El
Patrocinador y las Entidades de MLB (a) no otorgan ninguna garantía o
representación de ningún tipo relativa a ningún premio (o porción de este) y
(b) niegan cualquier garantía implícita.
EL GANADOR DEL PREMIO DEL SORTEO DEBE ESTAR DISPONIBLE PARA VIAJAR
DURANTE LAS FECHAS DE LA SERIE MUNDIAL DE MLB® DE 2024 O NO SERÁN
ELEGIBLE PARA RECIBIR EL PREMIO DEL SORTEO. Las fechas de salida y regreso están sujetas a cambios a criterio
exclusivo del Patrocinador. Todos los detalles del Premio del Sorteo son a
criterio exclusivo del Patrocinador. Si el Ganador del Premio del Sorteo no
pudiera participar en el Viaje en las fechas elegidas por el Patrocinador,
renunciará por completo al Premio del Sorteo y, si el tiempo lo permite, se
elegirá a un Ganador suplente. Si cualquiera de los eventos, o una porción de
los mismos, indicados en la descripción del Premio del Sorteo no se realizara o
no se pudiera realizar como se programó o en absoluto, por motivos incluyendo,
entre otros, conflictos de horarios, cancelaciones, postergaciones o cualquier
otro motivo, y asumiendo que el Ganador del Premio del Sorteo tiene la
disponibilidad y capacidad para viajar en las fechas elegidas por el
Patrocinador, el Ganador recibirá los componentes restantes del Premio del
Sorteo, que constituirán el cumplimiento total de la obligación del Premio del
Sorteo del Patrocinador con el Ganador y no se otorgará ninguna compensación
adicional o distinta. El valor real del Premio del Sorteo dependerá del punto
de partida, cualquier fluctuación de las tarifas aéreas y los precios de
temporada; no se otorgará ninguna diferencia. La selección de las fechas del
viaje es a criterio exclusivo del Patrocinador y del programa del Evento. En el
caso de que el Ganador del Premio del Sorteo viva dentro de una distancia
máxima de cien (100) millas de la ciudad anfitriona, el viaje aéreo no estará
incluido en el Viaje y se compensará al Ganador con un total de doscientos
dólares ($200) en lugar del viaje aéreo, por cualquier gasto alternativo de
viaje. El Patrocinador se reserva el derecho, a su criterio exclusivo, de
realizar un pago como deducción fiscal proyectada para ayudar a compensar la
responsabilidad del impuesto sobre la renta. Si aplica, se otorgará un
pago como deducción fiscal proyectada en forma de un cheque por una cantidad
determinada por el Patrocinador antes del 31 de diciembre de 2024. Si los
impuestos sobre la renta exceden dicha cantidad, los gastos adicionales serán
responsabilidad del Ganador del Premio del Sorteo, según corresponda.
El Invitado del Ganador del Premio del Sorteo debe tener por lo menos dieciocho
(18) años de edad y la mayoría de edad en su estado de
residencia principal, a menos que el Ganador del Sorteo sea el padre o tutor
legal del Invitado. Si el
Ganador del Premio del Sorteo tiene entre dieciocho (18) y veintiún (21) años de edad, puede necesitar que lo acompañe un adulto de
al menos veintiún años (21) de edad para registrarse en el hotel del lugar. El
Ganador del Premio del Sorteo y su Invitado deben viajar juntos en el mismo
itinerario para el Viaje y son responsables de obtener todos los documentos de
viaje necesarios. El Ganador del Premio del Sorteo y el Invitado aceptan
realizar el Viaje bajo su propio riesgo. Todos los preparativos del viaje
deberán realizarse a través del agente del Patrocinador. El Patrocinador
seleccionará a su criterio exclusivo la aerolínea para el Viaje. Se aplican los
reglamentos y condiciones de la compañía aérea. Pueden aplicarse otras
restricciones de viaje y fechas restringidas. Todos los boletos de avión están
sujetos a cambios por variación de vuelos, suspensiones laborales y cambios de
horario o de ruta. Una vez que se hayan reservado las fechas del Viaje, no se
permiten cambios, extensiones o sustituciones, excepto a criterio exclusivo del
Patrocinador. El Patrocinador no reemplazará ningún boleto o comprobante de
viaje perdido o robado. El Patrocinador se reserva el derecho de estructurar
las rutas de viaje y seleccionar los hoteles a su exclusivo criterio. Cualquier
costo del viaje que exceda el bono de viáticos establecido por medio del
presente, será la responsabilidad exclusiva del Ganador del Premio del Sorteo.
A fin de evitar cualquier duda, el Ganador del Premio del Sorteo será el
responsable exclusivo de todos los costos, gastos e imprevistos asociados con
la aceptación y el uso del Premio del Sorteo, incluyendo, entre otros,
transporte terrestre, comidas, bebidas, propinas, llamadas telefónicas,
seguros, impuestos, y cualquier otro gasto cuya inclusión no se haya mencionado
específicamente. Una vez que comience el viaje, no se permiten paradas no
programadas; si se presenta una parada no programada, podrá cobrarse la tarifa
aérea completa al Ganador del Premio del Sorteo a partir del punto de la parada
y para las secciones restantes del Viaje, incluyendo el regreso. Las Entidades
de la Promoción y las Entidades de MLB no son responsables de los gastos
incurridos como consecuencia de la cancelación o el retraso de vuelos. El Viaje
no puede combinarse con ninguna otra oferta, y el viaje no califica para
obtener millas de viajero frecuente. Las Entidades de la Promoción y las
Entidades de MLB no obtendrán un seguro de viaje a nombre del Ganador del
Premio del Sorteo o el Invitado. El Viaje está sujeto a la disponibilidad de vuelos
y pueden aplicarse otras restricciones al viaje. El Ganador del Premio del
Sorteo es responsable de todos los seguros de viaje y otros seguros aplicables,
todas las tarifas aeroportuarias correspondientes, incluyendo, entre otros,
cualquier cargo por equipaje, tasas aeroportuarias, cargos por combustible y
cualquier arancel correspondiente a la inspección de Aduanas o Federal. El
Patrocinador se reserva el derecho de cambiar las fechas de viaje y sustituir
cualquier o todas estas porciones del Premio del Sorteo por un premio de valor
comparable o mayor, en caso de falta de disponibilidad o de que resulten
inviables por cualquier motivo. TODOS LOS IMPUESTOS FEDERALES, ESTATALES Y
LOCALES, Y CUALQUIER OTRO COSTO Y GASTO ASOCIADO CON LA RECEPCIÓN O EL USO DEL
PREMIO DEL SORTEO SON RESPONSABILIDAD EXCLUSIVA DEL GANADOR DEL PREMIO DEL
SORTEO. El ARV de los premios de viaje es un valor que se calculó antes del
comienzo de la Promoción. Si el valor real de cualquier premio es menor al ARV
declarado en el presente, el Ganador del Premio del Sorteo NO tendrá derecho a
recibir un cheque, efectivo u otra forma de pago por la diferencia de precios.
El transporte aéreo de ida y vuelta para todo premio de viaje comienza y
termina en el punto de partida. No se incluyen otros gastos de hotel que, de
corresponder, podrían cobrarse al Ganador del Premio del Sorteo/Invitado en el
momento de la salida del hotel. Es posible que se requiera un depósito o pago
por adelantado, o la presentación de una tarjeta de crédito por parte del
Ganador del Premio del Sorteo al momento de registro en el hotel. Cualquier
cancelación o cambio de reservación de hotel después de la confirmación debe
hacerse directamente con el hotel, y el Ganador del Premio del Sorteo será el
responsable exclusivo de cualquier cambio y/o tarifa resultante de los cambios
realizados directamente con el hotel. El Ganador del
Premio del Sorteo no puede asignar o transferir el Premio del Sorteo a otra
persona, excepto a criterio del Patrocinador. Si el Premio del Sorteo no se
puede otorgar debido a circunstancias fuera del control del Patrocinador, se
otorgará un premio sustituto de valor comercial igual o mayor. Si se otorga el
Premio del Sorteo, pero el ganador no lo reclama o lo pierde, es posible que el
Premio del Sorteo no se reasigne, a criterio exclusivo de las Entidades de la
Promoción. Es posible que apliquen otras restricciones. El Premio del Sorteo, y
todas las porciones del mismo, se otorgan SIN GARANTÍA
DE NINGUNA CLASE, expresa o implícita, sin limitación. No se permite ninguna
sustitución del premio o alternativa en efectivo, excepto a criterio exclusivo
del Patrocinador. Cualquier representación del Premio del Sorteo es únicamente
para fines ilustrativos.
Conducta en el Viaje: El Ganador del Premio
del Sorteo y el Invitado se comportarán con la debida consideración a las
convenciones y la moral públicas. Ni el Ganador del Premio del Sorteo ni el
Invitado, mientras representen a las Entidades de la Promoción y las Entidades
de MLB durante el Viaje y/o cualquiera de los eventos, o una porción de ellos,
según se detallan en la descripción del Premio del Sorteo, cometerá un delito
que implique vileza moral según las leyes u ordenanzas locales. Ni el Ganador
del Premio del Sorteo ni el Invitado cometerán ningún acto que tienda a
degradar las Entidades de la Promoción y/o Entidades de MLB ante la sociedad,
ni que resulte en odio público, descrédito público, desprecio, desdén o
ridículo de las Entidades del Sorteo y/o Entidades de MLB, o que se destinen a
conmocionar, insultar u ofender a la comunidad o la moral o decencia pública, o
perjudiquen a las Entidades de la Promoción y/o Entidades de MLB. En caso
de que el Ganador del Premio del Sorteo o el Invitado se comporten (según lo
determinen las Entidades de la Promoción y/o Entidades de MLB a su exclusivo
criterio) de manera ofensiva o amenazante, ilegal o con la intención de
molestar, maltratar, amenazar u hostigar a cualquier otra persona, las
Entidades de la Promoción y/o Entidades de MLB se reservan el derecho de
expulsar al Ganador y al Invitado de cualquiera de los eventos, o una parte de
ellos, según se enumera en la descripción del Premio del Sorteo, terminar el
Viaje antes de tiempo, y enviar al Ganador y al Invitado a su lugar de origen
sin ninguna obligación adicional relacionada con el Premio del Sorteo.
ARV acumulado de todos los Premios: $703,000.00
En relación con cualquier Viaje y/o Evento, tenga en
cuenta que se deben seguir las políticas del Evento, los lineamientos de los
CDC y las recomendaciones de las autoridades de salud. Además, el Ganador del
Premio del Sorteo y el Invitado, si corresponde, debe conocer y cumplir los lineamientos
del gobierno con respecto a las restricciones de viaje y las cuarentenas
obligatorias antes de visitar cualquier destino. Tenga en cuenta que
cualquier lugar público en el que haya gente supone un riesgo inherente de exposición
al virus causante de la COVID-19, y el Patrocinador no puede garantizar que una
persona no estará expuesta durante el Viaje. Al aceptar un Premio, el
Ganador, en su representación y en la de todas las personas que utilicen el
Viaje o asistan a cualquier Evento como Invitado, asume expresamente el riesgo
de que durante el uso del Viaje y/o la asistencia al Evento pueda estar expuesto
a la COVID-19, al coronavirus que causa la COVID-19, o a otras enfermedades
transmisibles y/o infecciosas. El Ganador del Premio Mayor y el Invitado, si
corresponde, entienden expresamente que estos riesgos incluyen contraer
COVID-19 u otras enfermedades transmisibles y/o infecciosas y los peligros
asociados, complicaciones médicas y lesiones físicas y mentales, tanto
previstas como imprevistas, que pueden resultar de contraer la COVID-19 u otras
enfermedades transmisibles y/o infecciosas.
15.
CONDICIONES DE PARTICIPACIÓN/EXENCIÓN DE
RESPONSABILIDAD: Se aplican todas
las leyes y los reglamentos federales, estatales y locales. Al participar, cada
Participante acepta su conformidad a estas Reglas oficiales y a las decisiones
de las Entidades de la Promoción, que serán definitivas en todos los aspectos.
Al participar en esta Promoción y/o aceptar cualquier Premio, cada Participante
acepta eximir a las Entidades de la Promoción, Entidades de MLB, y cada uno de
sus respectivos sucesores, empleados, funcionarios, directores, agentes,
representantes y designados (colectivamente, las “Partes Exoneradas”) de
todas y cada una de las acciones, reclamaciones, lesiones, pérdidas o daños que
surjan de cualquier manera, directa o indirectamente, de la participación en
esta Promoción y/o la aceptación o el uso del cualquier Premio. Cada Participante
autoriza al Patrocinador, las Entidades de MLB y sus designados a usar su
nombre, voz, imagen, información biográfica, ciudad y estado o territorio de
residencia y materiales de Participación en la programación o el material
promocional, en todo el mundo a perpetuidad, y en una lista de ganadores, en
caso correspondiente, sin aviso previo ni compensación, a menos que la ley lo
prohíba. El Patrocinador y las Entidades de MLB no están obligados a usar
ninguna de la información ni los materiales antes mencionados, pero podrán
hacerlo y podrán editar dicho material e información, a su criterio, sin
ninguna otra obligación o compensación. Las Partes Eximidas no serán
responsables de: (i) ninguna lesión, pérdida, responsabilidad o daño de ningún
tipo causado por cualquier Premio o resultante de la aceptación, la posesión o
el uso del Premio correspondiente, o por participar en la Promoción; (ii) fallas del sistema telefónico, teléfono o hardware o
software informático u otra falla técnica o informática, pérdida de conexiones,
desconexiones, retrasos o errores de transmisión; (iii)
corrupción, robo, destrucción de datos, acceso no autorizado o alteración del
Pronóstico u otros materiales; (iv) Pronósticos
tardíos, perdidos, retrasados, robados, incompletos, ilegibles, inexactos,
confusos o ininteligibles, independientemente del método de transmisión; (v)
cualquier incapacidad del ganador para aceptar o usar algún Premio (o una
porción de este) por cualquier motivo, y dicho Premio o porción de este se
perderá; o (vi) cualquier error de impresión, tipográfico, administrativo
humano o tecnológico en cualquier material relacionado con la Promoción. Las
Entidades de la Promoción se reservan el derecho, a su criterio exclusivo, de
cancelar, modificar o suspender la Promoción (o cualquier porción de la
Promoción) en caso de que un virus, error, problema informático, una
intervención no autorizada, una circunstancia atenuante u otro problema o causa
corrompa o inhiba la administración, la seguridad o el buen funcionamiento de
la Promoción y, en tal situación, seleccionará a los ganadores a partir de los
Pronósticos no sospechosos, elegibles, recibidos antes de y/o después de tal
acción, o de tal manera que se considere justo y apropiado por parte de las
Entidades de la Promoción. Las Entidades de la Promoción podrán prohibir la
participación del Participante en la Promoción, o la recepción de un premio,
si, a su criterio exclusivo, determinan que el Participante está tratando de
socavar la operación legítima de la Promoción con engaños, piratería informática,
manipulación, o cualquier otra práctica injusta, o con la intención de
molestar, maltratar, amenazar u hostigar a cualquier otro Participante, a los
representantes de las Entidades de la Promoción o las Entidades de MLB.
PRECAUCIÓN: CUALQUIER INTENTO DE SOCAVAR DELIBERADAMENTE EL FUNCIONAMIENTO
LEGÍTIMO DE LA PROMOCIÓN PUEDE INFRINGIR LEYES PENALES Y CIVILES Y RESULTARÁ EN
LA DESCALIFICACIÓN DE LA PARTICIPACIÓN EN LA PROMOCIÓN. EN CASO DE TAL INTENTO,
LAS ENTIDADES DE LA PROMOCIÓN Y ENTIDADES DE MLB SE RESERVAN EL DERECHO DE
EXIGIR LA REPARACIÓN POR DAÑOS Y PERJUICIOS (INCLUYENDO LOS HONORARIOS DE LOS
ABOGADOS) EN LA MEDIDA REQUERIDA POR LA LEY, INCLUYENDO LA ACCIÓN PENAL. AL
PARTICIPAR EN LA PROMOCIÓN, EL PARTICIPANTE ACEPTA QUE, EN LA MEDIDA QUE LO PERMITA
LA LEGISLACIÓN APLICABLE: (1) TODAS Y CADA UNA DE LAS DISPUTAS, RECLAMACIONES Y
CAUSAS DE ACCIÓN JUDICIAL QUE SURJAN O ESTÉN RELACIONADAS CON LA PROMOCIÓN, O
CUALQUIER PREMIO OTORGADO, SE RESOLVERÁN INDIVIDUALMENTE, SIN RECURRIR A
NINGUNA FORMA DE ACCIÓN COLECTIVA; (2) TODAS Y CADA UNA DE LAS RECLAMACIONES,
LOS JUICIOS Y LAS ADJUDICACIONES SE LIMITARÁN A LOS GASTOS REALES DE BOLSILLO
DE TERCEROS EN LOS QUE SE HAYA INCURRIDO (SI HUBIERA), QUE NO EXCEDAN LOS
DOSCIENTOS CINCUENTA DÓLARES ($250.00), PERO EN NINGÚN CASO LOS HONORARIOS DE
LOS ABOGADOS SERÁN ADJUDICADOS O RECUPERABLES; Y (3) BAJO NINGUNA CIRCUNSTANCIA
SE PERMITIRÁ A NINGÚN PARTICIPANTE OBTENER NINGÚN PREMIO CORRESPONDIENTE, Y EL
PARTICIPANTE, POR LA PRESENTE, CONSCIENTE Y EXPRESAMENTE, RENUNCIA A TODOS LOS
DERECHOS PARA EXIGIR INDEMNIZACIONES PUNITIVAS, INCIDENTALES, CONSECUENTES O
ESPECIALES, LUCRO CESANTE, Y/O CUALQUIER DERECHO A QUE LOS DAÑOS SE
MULTIPLIQUEN O AUMENTEN DE OTRO MODO.
ALGUNAS JURISDICCIONES NO PERMITEN LA LIMITACIÓN O EXCLUSIÓN DE
RESPONSABILIDAD, POR LO QUE LO ANTERIOR PUEDE NO APLICARSE A USTED.

LEY APLICABLE:
TODAS LAS DUDAS Y PREGUNTAS EN RELACIÓN CON LA
CONSTRUCCIÓN, VALIDEZ, INTERPRETACIÓN Y APLICABILIDAD DE ESTAS REGLAS
OFICIALES, O LOS DERECHOS Y OBLIGACIONES DE LOS PARTICIPANTES O EL PATROCINADOR
EN RELACIÓN CON LA PROMOCIÓN, SE REGIRÁN E INTERPRETARÁN DE ACUERDO CON LAS
LEYES INTERNAS DEL ESTADO DE WASHINGTON, SIN DAR EFECTO A NINGÚN DERECHO
APLICABLE O CONFLICTO DE LAS NORMAS O DISPOSICIONES DE LEYES QUE CAUSE LA
APLICACIÓN DE LEYES DE CUALQUIER OTRO ESTADO. AL PARTICIPAR, LOS PARTICIPANTES
ACEPTAN LA JURISDICCIÓN Y COMPETENCIA DE LOS TRIBUNALES FEDERALES, ESTATALES Y
LOCALES DEL CONDADO DE KING, WASHINGTON.
17.
DISPOSICIÓN DE ARBITRAJE: Al participar en esta
Promoción, cada Participante acepta que todas las disputas que pueda tener el
Participante con, o reclamaciones del Participante en contra de, las Partes
Eximidas en relación con, que surjan de o estén conectadas de alguna manera con
(i) la Promoción, (ii) el otorgamiento o redención de
cualquier premio, y/o (iii) la determinación del
alcance o la aplicabilidad del presente acuerdo para el arbitraje, se
resolverán individual y exclusivamente por medio de un arbitraje definitivo y
vinculante administrado por el Foro Nacional de Arbitraje (el “Foro”) y se
llevarán a cabo ante un único árbitro de conformidad con el Código de
Procedimiento establecido por el Foro. El arbitraje se celebrará en el lugar
determinado por el Foro de conformidad con el Código de Procedimiento, o en
cualquier otro lugar que acuerden mutuamente el Participante y el Patrocinador.
La decisión del árbitro se regirá por los términos y condiciones de estas
Reglas oficiales y de todo otro acuerdo mencionado en el presente que haya
firmado el Participante en relación con la Promoción. No habrá autoridad para que ninguna
reclamación sea arbitrada con base en clase o representativa; el arbitraje
puede decidir únicamente en relación con las reclamaciones individuales del
Participante y/o Patrocinador, y el árbitro no puede consolidar o unir
reclamaciones de otras personas o partes que presenten situaciones
similares. El árbitro no tendrá la
facultad de conceder indemnizaciones especiales o punitivas en contra del
Participante o las Partes Eximidas. Para

Si cualquier parte de esta Disposición de Arbitraje se considerara no
válida o de otro modo no ejecutable o ilegal, el resto de la presente
Disposición de Arbitraje permanecerá en vigor y se interpretará de acuerdo con
sus términos como si la disposición no válida o ilegal no estuviera contenida
aquí.
18. POLÍTICA DE PRIVACIDAD: Toda información personal que usted le proporcione al Patrocinador
estará sujeta a la política de privacidad del Patrocinador publicada en https://www.t-mobile.com/responsibility/privacy/privacy-policy. Al participar en la Promoción, usted concede al
Patrocinador permiso para compartir su número de teléfono móvil, correo
electrónico y cualquier otra información de identificación personal con las
otras Entidades de la Promoción y Entidades de MLB, para los fines de la
administración de la Promoción y el cumplimiento del Premio. El Patrocinador no
venderá, rentará, transferirá, ni divulgará de otra manera sus datos personales
a ningún tercero, excepto como se describe explícitamente aquí, o en cumplimiento
con la política de privacidad del Patrocinador.
